As a condition of the town council’s approval, the applicant
must execute a legal agreement which specifies the terms and conditions
and the understandings between the parties with respect to the regulations
set forth in this article.
(1998 Code, sec. 155.130)
(a) The town council may require a performance bond for such improvements
as it deems should be bonded in a form as may be approved by the town
attorney before any work commences on a development. The steps for
issuing and releasing a performance bond (or other surety) shall be
the same as required in the pertinent zoning ordinance(s) and subdivision
regulation(s), including but not limited to determining the amount,
the sufficiency, and the term and form of the bond (or other surety).
(b) No development may be occupied or used unless a certificate of occupancy
has been issued by the building inspector. The building inspector
shall not issue such certificate of occupancy until the regulations
set forth in this article have been complied with and improvements
made or a performance bond (or other approved surety) provided to
the town for unfinished improvements.
