The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Construction materials.
Includes wood, lumber, scraps of iron, tin, wire or any other metals, rubber, barrels, crates, shingles, concrete or other hard substances such as brick, broken concrete, clinkers, cinders, dirt, plaster and/or gravel, automobile frames, dead trees and other bulky, heavy materials.
Dry kitchen refuse.
The solids after the liquid or slop has been drained off.
Garbage.
Kitchen refuse, rags, old clothing, cardboard boxes, small children’s toys, garden hoses, and packing materials.
Garbage container.
For residential or small commercial customers, a can, either metal or plastic, or plastic bags, and for large commercial or industrial customers either/or dumpster(s) and/or roll-off container(s).
Hazardous materials.
Shall include paint, paint cans, gas cans, chemicals, oil, cleaners and solvents.
Household recyclables.
Shall include paper and paper products, magazines, catalogs, telephone books, cardboard and paperboard products, aluminum cans, trays and foil, glass bottles and containers and plastic containers and bags.
Junk.
Shall include discarded furniture, mattresses and box springs, appliances and other items of no value to the owner.
Kitchen garbage.
Dry kitchen refuse, meat, vegetable and fruit refuse; and small dead animals and dead fowl from any premises.
Kitchen refuse.
Wastes created by food preparation which has been drained of oils and grease and recyclables which include tin and aluminum cans, bottles, glass, plastic and paper products of all kinds.
Premises.
Business houses, boardinghouses, offices, theaters, hotels, restaurants, cafes, eating houses, tourist camps, apartments, sanitariums, rooming houses, schools, private residences, vacant lots and all other places within the city where garbage, trash or rubbish accumulates in ordinary quantities.
Rubbish.
Tin cans, bottles, glass, scraps of iron, tin, wire or any other metals or hard substances from any premises within the city limits.
Trash.
Papers of all kinds, rags, old clothing, paper containers, old rubber, pieces of wood, boxes, barrels, crates, feathers, weeds, grass and tree limbs from any premises within the city limits.
Yard trimmings.
Grass clippings, leaves, tree limbs and branches, and flower, garden and plant cuttings.

It shall be the duty of every person owning, managing, operating, leasing or renting any premises or any place where household garbage accumulates to provide a portable garbage container constructed of galvanized iron, tin or other suitably durable metal or plastic, with two (2) handles and a tightfitting cover and a capacity not less than five (5) gallons or more than thirty (30) gallons and not exceeding fifty (50) pounds. Durable plastic garbage bags may also be used for the collection of garbage.

Garbage containers shall be kept in a sanitary condition and closed tightly. Plastic bags must be securely tied and, if torn, double bagged. Places where containers and bags are located to be collected by the city garbage department shall be kept in a sanitary condition to prevent odors and flies. The contents of all containers and bags shall be so protected that the wind cannot blow out and scatter the same over the streets, alleys, other premises of the city and any neighboring premises.

It shall be the duty of every person owning, managing, operating, leasing or renting any premises to place the yard trimmings collected by the resident or owner only from such premises in boxes, bags or containers of reasonable size, the gross weight of which does not exceed fifty (50) pounds. Tree limbs which are trimmed by the occupant or owner of the residence shall be cut into lengths not exceeding three (3) feet.

(a) 
Garbage containers, bags, boxes, or bundles shall be placed inside the property line at the edge of the alley or other location convenient and readily accessible to the city’s collection department for the picking up of such containers, bags, boxes, or bundles.
(b) 
Collection of residential household waste shall be accomplished once each week, with the town divided into the north and south sides by the existing railroad tracks. Collection of such waste on the north side of the city shall be on Tuesday of each week and collection of such waste on the south side of the city shall be on Thursday of each week.

Household waste, including lawn and tree trimmings, shall not be collected on official city holidays, a list of which shall be provided by regular mail to each customer and which shall be available at the office of the city secretary.

The city and Fayette County Precinct 4 provide a joint collection site for residents who choose to participate in a voluntary recycling program for the disposal of glass products, paper products, cardboard products, plastic products, steel and aluminum products, and oil. The hours of operation of the recycling center are on file in the city secretary’s office at city hall.

Each year, the residential customers of the city may participate in the city-wide cleanup. Through this project the city will provide a drop-off collection site for household items, such as furniture, appliances, lawn and garden equipment, tools and construction materials such as wood, lumber, tin and other metals which have been grouped and stacked together. Appliances must be freon-free and tagged by a licensed dealer. The city does not collect concrete, shingles, siding, tires, batteries, and oil on this cleanup. Dates, times and specific details for the cleanup are on file in the city secretary’s office.

The meddling with garbage containers and bags or in any way pilfering from the same or scattering the contents thereof in any alley or street within the city limits is strictly prohibited, except, however if permission is granted by the person in control of the property where the contents are located.

The collection of garbage or any kind of junk within the city limits shall be performed by the city, and any collection is prohibited except by the city garbage department and its authorized agents.

There shall be charged, assessed and collected for garbage by the city a fee, to be set by the city council, the amount of which shall be on file in the city secretary’s office and as set forth in the fee schedule in appendix A of this code.

The city garbage department and/or its authorized agent will not make collection of garbage, junk, and/or yard trimmings where the same is not prepared for collection and placed as designated by the terms of section 13.06.005. Such failure to collect shall not affect any prosecution for a violation of this article.

The placing of any garbage, junk, yard trimmings or any other articles, thing or material in the main traveled thoroughfare in any street or alley within the city is prohibited.

It shall be unlawful, within the city limits, to burn garbage, junk or yard trimmings in any form, except under the supervision of an authorized city employee.

Anyone needing to dispose of garbage, junk or construction materials not collected by city garbage department through regular pickups or the city-wide cleanup may do so at the transfer station of their choice and is responsible for all fees. Roll-off containers are available on a limited basis to utility customers for construction, cleanup or heavy accumulations of wastes. These wastes shall be disposed of at the expense of the owner or person controlling the same under the direction of the city administrator.

All junk and other materials at the disposal site collected during the city-wide cleanup are the property of the city, and no person shall separate, collect, carry off or dispose of the same except under the direction of the city administrator or other authorized city employee.

It shall be unlawful for any person to bury the dead carcass of any animal within the city. Heavy dead animals, such as cows, horses and mules, shall be delivered to or picked up by some authorized animal rendering plant at the expense of the owner or person having the same in charge in the manner and by the method directed by designated city officials. Small pets such as dogs and cats shall be delivered to or may be picked up by the city depending on the circumstance, and one shall call the city office for detailed instructions.

Manure from cow lots, horse stables, poultry yards and pigeon lots and waste oils from garages, filling stations or restaurants shall be disposed of at the expense of the party responsible for the same and under the advisement of the city administrator.

(a) 
It shall be unlawful for any person to place garbage, junk, recyclables, or construction materials into a residential or commercial container not belonging to or under the control of such person without the consent of the owner of the container or the person legally entitled to the use and possession of such container.
(b) 
Anyone found to have violated this provision shall be guilty of a misdemeanor and punished in accordance with section 1.01.009 of this code.
