A. 
No individual(s), firm or corporation shall place upon any private property within the Borough any dumpster or other similar container commonly used for the collection of building materials as hereinafter defined except in compliance with the provisions of this article and after the issuance of a permit in accordance herewith.
B. 
Dumpsters located on private property, regardless of their size, which are neither rented on a permanent basis nor which have regularly scheduled pickups of at least two times per month are obligated to comply with all provisions of this Article II.
A. 
Any individual(s) desiring a permit shall make written application therefor to the Borough Clerk specifying the exact proposed location of such dumpster, collapsible dumpster bag, container or other receptacle, the size and capacity thereof, the name of the owner of the abutting property(ies), the length of time that the use is required, and such other information as may be required by the Borough Zoning Officer who shall review and approve or reject the permit.
B. 
All dumpsters, but not collapsible dumpster bags, shall prominently display an identification number assigned by the State of New Jersey as well as the name, address, and telephone number of the owner responsible therefor.
The application for a permit shall be accompanied by a fee of $25. No dumpster or dumpster bag shall be placed, located or situated on any private property unless and until a permit for same has been issued by the Borough's Zoning Officer, Construction Code Official, or by the Borough's Clerk.
A. 
The Milford Borough Zoning Officer may in the Zoning Officer's discretion refuse to issue a permit if it is determined that same constitutes a danger to public health, safety, or welfare.
B. 
No permit shall be granted by the Borough Clerk for a term longer than 45 days.
C. 
Dumpster: No dumpster shall remain in place or be situated on any private property for a period in excess of 45 days from the date of the issuance of the permit for same as required in this article, provided, however, that such period may be extended by the Borough's Zoning Officer or Construction Code Official for good cause.
D. 
Collapsible dumpster bag: No dumpster bag shall remain in place or be situated on any private property for a period in excess of 30 days from the date of the issuance of the permit for same required in this article, provided, however, that such time period may be extended by the Construction Code Official for good cause.
E. 
The permit is renewable for an additional five-day period at the discretion of the Milford Borough Zoning Officer for an additional fee of $10 for each additional permit extension sought.
F. 
Upon the expiration of the permit, the permit holder shall immediately remove or cause to be removed the dumpster or similar container from the subject private property.
A. 
The dumpster or other similar container shall not be filled higher than the top edge of the dumpster to prevent debris or materials from falling or being blown outside of the container.
B. 
The dumpster or other similar container shall, when not being actively loaded, have a covering that is adequately secured to the dumpster or other similar container to prevent materials from falling or being blown outside of the container.
C. 
No garbage, refuse or trash, or recyclable materials, or household waste shall be placed in any dumpster nor any other material(s) not permitted by the owner of the dumpster.
Any individual(s) violating the terms of this article shall, upon conviction, pay a fine of not less than $100 per day with each day representing a separate offense.
