As used in this article, the following words and phrases shall
have the meanings respectively ascribed to them:
Premises.
Any business house, business establishment, private residences,
vacant lots, and all other places of business or place in the city
where garbage, trash or rubbish accumulates.
Rubbish.
All tin cans, bottles, glass, scraps of iron, tin, wire or
other metals, and any other articles to which the term “rubbish”
is usually applied.
Trash.
Paper of all kinds, rags, old clothing, paper containers,
pieces of wood, tree limbs, hedge cuttings, boxes, barrels, crates,
feathers, and any other articles to which the term “trash”
is usually applied.

The emptying or disposing of any garbage, trash, refuse or rubbish,
or the accumulation of any such matters, in any place within the city
is hereby prohibited, and no one except the duly authorized agents
and employees of the city shall collect garbage and refuse or empty
[containers containing garbage or refuse substances, or convey or
transport garbage or refuse substances over the streets, alleys, and
public thoroughfares of said city, except as otherwise expressly provided
in this article].

[The city will make or cause to be made regular collections
from the containers for the removal of trash and rubbish from all
premises in the business district of the city as is necessary to maintain
sanitary] conditions. In residential districts, garbage containers
(dumpsters) shall be emptied by the city each week as is necessary
to maintain sanitary conditions. The time of such collection shall
be announced by the proper officials of the city.

(a) Trash or rubbish permitted herein to be deposited in containers (dumpsters)
provided by the city shall not exceed four (4) feet in length.
(b) It shall be the responsibility of the owner, operator, or occupant
of any premises, store, factory, or business for the disposal of all
trees, automobile bodies, abandoned automobiles, tires, industrial
waste, hazardous waste, including household hazardous waste such as
paints and insecticides, tires and household appliances, and similar
materials.
(c) It shall be the responsibility of the owner or occupant of any premises
to properly dispose of dirt, grass, trash and other waste resulting
from yard work. Grass clippings may be placed in the containers if
bagged.

In order to defray the cost and expense of collecting and disposing
of garbage, trash and rubbish in the city there is hereby levied and
assessed, and there shall be charged and collected from each and every
person owning, leasing, managing, occupying or operating any premises
within the business or residential district the following charges:
(1) Residential rate of $22.00 per month per household for 1 pickup per
week for a 1-1/2 yard dumpster.
(2) Commercial for each business served:
(A) One pickup in each week:
(i) $47.17 per month for a 1-1/2-yard container;
(ii)
$55.31 per month for a 3-yard container;
(iii)
$74.65 per month for a 4-yard container.
(B) Two pickups each week:
(i) $58.72 per month for a 1-1/2-yard;
(ii)
$81.30 per month for a 3-yard;
(iii)
$107.72 per month for a 4-yard.
(3) Additional charges as established by the city council on a case-by-case
basis shall be made for additional containers.

Payment of all charges assessed for the collection of garbage,
rubbish and refuse shall be made at the same time as payment for other
utility services provided by the city. Failure to timely pay for trash
collection shall authorize the city to discontinue the provision of
all utility service.

It shall be unlawful for any person within the city to burn
or permit the burning of kitchen garbage, trash, rubbish, including
grass clippings or any other yard waste in or upon any premises within
the city whatsoever.

It shall be unlawful for any person to place or dispose of any
kitchen garbage, trash or rubbish in or upon any street, alley or
sidewalk within the city. Every owner or operator of any premises
shall keep the alleys, streets and sidewalks abutting such premises
free and clear of all such garbage, trash and rubbish.

Any person, firm or individual who shall violate any of the
provisions of this article shall be guilty of a misdemeanor, and upon
conviction shall be fined in a sum not exceeding two thousand dollars
($2,000.00). Each and every day the violation continues shall constitute
a separate and distinct offense.
