Annual permit.
For the purpose of this article, the annual permit will be a document issued by city hall for the city, which signifies the permit holder is in compliance with this article. All permits will expire the 31st day of December each calendar year and must be renewed and updated in order to provide work or services within the city limits.
Building permit.
For the purpose of this article, building permit is intended to mean a document issued by the building inspector and city hall for the purpose of authorizing and inspecting work performed at any residence in the city limits. This building permit must be issued prior to any work commencing.
Contractor.
Is intended to include any business, firm, corporation, contractor, builder, and any employee or representative thereof, or any individual providing skills and/or services associated with the process of removing old shingles or roofing materials and replacing with new; also intended to include the application of new shingles or roofing materials over existing materials without the removal of the old.
Shingle.
Is intended to include any asphalt, fiberglass, or combination based product which is customarily and routinely installed in evenly spaced rows on the roof of dwellings and structures to assist in the deflection of rain and other elements of nature.

(a) 
The city council has determined that in addition to the commercial and residential buildings complying with the International Building Code and the International Residential Code, the provisions of this article are also essential to insure local residents and property owners are not taken advantage of or extorted in any way by unscrupulous, dishonest, inexperienced, or corrupt business owners and workers.
(b) 
With the frequency of severe weather and specifically hail in our region, the need to further regulate who is recognized and authorized to perform work on exterior roofs in the city limits is acknowledged.

(a) 
The intent of the city council is to improve the process of registering and keeping records of anyone performing roofing services in the city.
(b) 
A violation shall occur any time any products or materials are not disposed of properly or kept on the property on which the contractor is performing services, and each violation is a separate violation and shall be punishable in accordance with section 3.06.004 as a separate offense each time such violation occurs.

Any person, persons, citizen, corporation, business, or employee thereof who violates any provision of this article or any section or subsection of this article shall be deemed guilty of a misdemeanor and, upon conviction thereof in municipal court, shall be subject to a fine in the sum not to exceed one thousand dollars ($1,000.00) for each violation for which they are deemed guilty.

(a) 
Upon passage and acceptance of this article, any and all businesses, corporations, contractors, builders, firms, or individuals for hire, engaging in the process and practice of removal and installation of shingles and other like or similar roofing products, shall be required to obtain a building permit from the city to legally perform work inside the city limits.
(b) 
In addition to any building permit, the contractor, builder, business, corporation, firm, or individual for hire must obtain an annual building permit issued by the city. This permit is valid for a calendar year or any remaining part of the calendar year after its issuance. Such permits will expire on December 31st of the year in which they are issued, or until revoked, whichever occurs earliest.
(c) 
The permit must be carried (or in the possession of) so that it may be presented if and when requested by the city building inspector, police department, or any designated agent thereof. If the person performing the work does not have a valid and current permit as well as a building permit, all work will stop until such valid and current permits are obtained or produced.
(d) 
For compliance with this article, any contractor, builder, business, corporation, firm, or individual providing labor, skills, or materials commonly associated with the application or installation of roofing materials must obtain a permit.
(e) 
The permit will require that this same contractor, builder, business, corporation, firm, or individual must:
(1) 
Produce satisfactory proof to the city of a general liability insurance policy, insuring such entity obtaining the permit; that such entity has a minimum of $100,000.00 per occurrence and $200,000.00 aggregate of general liability insurance totally [sic] the actions of the entity or person obtaining such permit in performance of any roofing contracts for citizens of the city, a copy of such liability shall remain at city hall.
(2) 
Be bonded with a compliance bond in a minimum sum of $10,000.00, a copy of such bond to remain at city hall.
(3) 
Provide information such as but not specifically limited to: name of business, name of principal owner(s), address, telephone number, and a copy of a valid driver’s license or other verifiable identification.
(f) 
A homeowner seeking to perform repair or replacement of roofing materials on property owned by him or her is not required to obtain an annual permit; however, homeowners are required to obtain a building permit.
For clarification – If a homeowner indicates that he or she will be performing the roof repairs and then hires, contracts, subcontracts, or in any way solicits the assistance of a contractor, builder, business, corporation, firm, or individual or employees thereof, then the homeowner must comply with all aspects and stipulations of this article.
(g) 
The city will charge a fee to issue a permit to any entity or person obtaining a permit in the amount of $30.00 per permit.

(a) 
It shall be the responsibility of the permit holder to properly dispose of all roofing materials and debris. Under no circumstance will any roofing materials or debris be allowed to be disposed of in the city dumpster containers.
(b) 
Furthermore it shall be the responsibility of the permit holder to properly dispose of all wrapping, paper, packing, or roofing-related materials. Every effort should be used to contain these types of products and keep this material from blowing or ending up on surrounding property. When roofing-related products end up in or on neighbors’ properties it shall be the permit holder’s responsibility to clean up and remove all this material.
