A corporation court as provided for in V.T.C.A., Government Code, chapter 29 be, and the same is hereby created. Said court shall have jurisdiction within the limits of said city in all criminal cases arising under the ordinances of said city now in force or hereafter to be passed, and shall also have jurisdiction concurrent with any justice of the peace in the precinct in which the said city is situated, in all criminal cases arising under the criminal laws of the state, in which the punishment is by fine only and where the maximum of such fine may not exceed $20.00 and arising within the said limits of said city.

The recorder of the court will be appointed by the city council. The city clerk shall be the clerk of said court, and it shall be his duty to keep the minutes of the proceedings of the court, to issue all process and generally to do and perform all the duties of the clerk of said court, as prescribed by law for the clerk of the county court, insofar as said provision may be applicable.

Every person brought before the recorder to be tried for an offense for which the penalty may be a fine or imprisonment or both shall be entitled, if he shall demand it, to be tried by a jury of six legal voters of the city who shall be summoned, impaneled and qualified as jurors are in justice courts under the laws of the state.

The fees, costs, fines, juror and witness fees, pleading practice and procedure, and rules of evidence in said court shall be governed by the provisions of V.T.C.A., Government Code, chapters 29 and 102 and the Texas Code of Criminal Procedure, and the ordinances of the city now or hereafter to be adopted.

The said corporation court shall have a seal having engraved thereon a star of five points in the center, and the words, “Corporation Court, in Idalou, Texas,” the impress of which shall be attached to all proceedings except subpoenas issued out of said court and shall be used to authenticate the official acts of the clerk and recorder, where they or either of them is authorized or required to use the seal of office.

Said court shall be held in a room or place to be hereafter provided for by resolution of the city council, the session to commence at 10:00 a.m., but each defendant shall be entitled to one day’s notice of any complaint against him, if such time shall be demanded by such defendant.

This article shall take effect ten days after its passage and the first session of said court shall be held on Monday, January 20th 1924. Said court shall hold no terms but shall at all times be open for the transaction of business.
