ORDINANCE NO. 1852
AMENDED COMPREHENSIVE ZONING ORDINANCE
AN ORDINANCE REPEALING ORDINANCE NUMBER 1850, BUT NOT THE EXTENSION ORDINANCES OF SAME, THAT CONFLICT WITH THE TERMS OR CONDITIONS OF THIS ORDINANCE, PARTICULARLY INCLUDING ORDINANCE #1850 AND ENACTING IN LIEU THEREOF AN AMENDED ORDINANCE PROVIDING FOR LAWS AND POLICIES REGARDING THE CITY OF RENO, LAMAR COUNTY, TEXAS; PROVIDING THAT ANY VIOLATION OF THE ORDINANCE SHALL BE A MISDEMEANOR; AND PROVIDING FOR PUNITIVE SANCTIONS FOR THE VIOLATION OF THE ORDINANCE.
WHEREAS, The City Council in order to continue the protection of the health and welfare of its citizens living within the city through planning and zoning, shall amend the zoning regulations and districts that have been adopted and/or amended in accordance with the comprehensive plan; and
WHEREAS, The City Council has reviewed the zoning regulations (and amendments) with the current members of the Reno Planning and Zoning Commission along with the City Attorney and submitted the amended ordinance hereto as Exhibit “A”; and
WHEREAS, The City Council finds that the amended ordinance shall be adopted, after two publicized public hearings, as an ordinance of said city, therefore;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RENO, LAMAR COUNTY, TEXAS:
SECTION 1. The title, caption, ordaining clause, and all other parts of this ordinance, as well as the contents of the Exhibit “A”, attached hereto, are incorporated herein by reference and made part hereof.
SECTION 2. Each part of the amended ordinance is intended to stand independently. Therefore, if any part of the amended ordinance becomes invalid because of federal or state law or other authority, it shall not affect the validity or application of other parts of the ordinance.
SECTION 3. The city adopts as its amended ordinance, the contents of Exhibit “A” in its entirety, to include punitive provision.
SECTION 4. The ordinance shall become effective on posting and publication as required by law.
SECTION 5. If any part of this amended ordinance shall be declared invalid by a court of competent jurisdiction, such ruling shall not affect the validity of the remainder of the ordinance.
