The speed of railroad trains through the city shall be governed
and regulated by the rules and regulations adopted by the federal
government as applicable to the speed of trains through incorporated
municipalities.

(a) Definition.
In this section:
Engine brakes.
"Jake" brakes, engine compression brakes, engine exhaust
brakes, or any other engine retarding device or method, including
venting the cylinder of the diesel engine midway through its cycle
causing the engine to absorb power; which produces excessive noise
beyond normal motor vehicle engine operating noise.
(b) Offense.
An operator of a motor vehicle is prohibited
from using engine brakes within the city limits.
(c) Penalty.
Any person who shall violate any of the provisions
of this section shall be guilty of a misdemeanor and, upon conviction,
shall be fined in any sum not to exceed $500.00 per separate offense.
(d) Defense.
It is a defense to the violation of this section
that the motor vehicle is an emergency vehicle, and the operator of
the motor vehicle is using engine brakes while responding to an emergency.
