For the protection and preservation of the health, safety, property and the general welfare of the people of the city, the city now adopts Texas Occupations Code, title 8, Regulation of Environmental and Industrial Trades, chapter 1301, plumbers, as amended from time-to-time, cited as the "plumbing license law," in its entirety as its own. All plumbing work and plumbing inspections done in the city must be done in accordance with the plumbing license law.

(a) 
A certain document, one copy which is on file in the office of the city manager, being marked and designated as the "International Plumbing Code," 2021 edition, including appendix B, C, D, and E published by the International Code Council, is now adopted as the code of the city for regulating the design, construction, quality of materials, erection, alteration, installation, repair, replacement, location, relocation, addition to, use or maintenance of plumbing systems in the city and the issuance of permits and collection of fees. This document is on file in the office of the city manager, and is now referred to, adopted and made a part of this section as if fully set out in this division.
(b) 
The following sections of the International Plumbing Code are hereby revised:
Section 101.1 Administration: Insert [City of Denver City]
Section 103.1 Code compliance agency: Insert [Building Department]
Section 115.4 Violations, unlawful acts: Insert, [Offense or Misdemeanor, not to exceed $500.00]

Before any person, firm or corporation shall engage in the business of plumbing in the city, he, it, or they shall first obtain the proper license and deposit with the city a certificate of insurance that is:
(1) 
Written by a company licensed to do business in the state;
(2) 
Provides for commercial general liability insurance for the master plumber for claims for property damage or bodily injury, regardless of whether the claim arises from a negligence claim or on a contract claim;
(3) 
Be in a coverage amount of not less than $300,000.00 for all claims arising in any one year period;
(4) 
Conditioned that the person, firm, or corporation engaged in the plumbing business will faithfully observe all the laws pertaining to plumbing; and
(5) 
That the city shall be indemnified and saved harmless from all claims arising from accidents and damage of any character whatsoever caused by the negligence of such person, firm, or corporation engaged in the plumbing business, or by any unfaithful or inadequate work done either by themselves, their agents or employees.

(a) 
Position of plumbing inspector.
The city manager shall appoint the plumbing inspector and any assistants necessary to aid him in the discharge of his duties.
(b) 
Qualifications of plumbing inspector.
The plumbing inspector shall have a license that entitles the individual to do plumbing inspections as an employee of a political subdivision, or, if approved by the board under section 1301.002 (8) of the Plumbing License Law, as an agent of a political subdivision.
(c) 
Plumbing inspector to avoid conflicts of interest.
The plumbing inspector shall not be directly or indirectly engaged in the business of plumbing or with plumbing suppliers.
(d) 
Compensation of inspector.
The plumbing inspector shall receive as full compensation for his services a salary designated by the city.
(e) 
Duties of plumbing inspector.
The plumbing inspector shall:
(1) 
Enforce all provisions of this division, and such inspector is now granted the authority to enter all buildings within or without the corporate limits of the city when such buildings are connected, or are to be connected, to the municipal gas, water, and/or sewer system.
(2) 
Prepare or cause to be prepared suitable forms for applications, permits, inspection reports and other such materials.
(3) 
Inspect and approve all plumbing work for compliance with this division and its adopted plumbing code, and to enforce changing of such installations that do not meet the requirements. It further shall be the inspector's duty to see that all persons installing or altering plumbing shall be qualified by state law.

All applications for permits shall be made on suitable forms provided and in accordance with the rates and fees schedule provided by resolution as amended from time-to-time. All fees to be in effect shall be paid at the time a permit is issued.

Whenever in the plumbing code, or in any ordinance of the city amending such code, an act is prohibited or is made or declared to be unlawful or an offense, or wherever in such code or ordinance the doing of an act is declared unlawful, and no specific penalty is provided thereof, the violation of any such provision of such code or any such ordinance shall be punishable by a fine not to exceed $2,000.00; provided, however, that no penalty shall be greater or lesser than the penalty provided for the same or similar offense under the laws of the state. Each day any violation of this plumbing code or of any ordinance shall continue shall constitute a separate offense.

The city reserves the right at any time to change, amend, alter, repeal, rescind, or add to these rules and regulations or any part thereof or to adopt any new rule or regulation or any temporary exception with respect to plumbing or anything pertaining thereto.
