A certain document, one copy of which is on file and is open for the inspection of the public in the office of the city manager, being marked and designated as the International Energy Conservation Code, 2021 edition as published by the International Code Council, is now adopted as the energy conservation code of the city, for regulating and governing the energy efficient building envelopes and installation of energy efficient mechanical, lighting, and power systems as herein provided; and providing for the issuance of permits and the collection of fees therefor. Each and all regulations, provisions, penalties, and conditions of terms of said energy conservation code on file in the office of the city manager are now referred to, adopted, and made a part hereof, as if fully set out in this division, with the additions, insertions, deletions and changes, if any, prescribed in section 3.02.402.

Whenever in the energy conservation code an act is prohibited or made or declared to be unlawful or an offense, or wherever in such code the doing of an act is declared unlawful and no specific penalty is provided thereof, the violation of any provision of such code or such ordinance shall be punishable by a fine not to exceed $500.00; provided, however, that no penalty shall be greater or lesser than the penalty provided for the same or similar offense under the laws of the state. Each day any violation of this code or of any ordinance shall continue shall constitute a separate offense.

The city reserves the right at any time, to change, amend, alter, repeal, rescind, or add to these rules and regulations or any part thereof or to adopt any new rule or regulations or any temporary exception with the respect to the International Energy Conservation Code or anything pertaining thereto.
