Any person who violates or fails to comply with any of the provisions of this article shall be guilty of a misdemeanor, and upon conviction shall be fined by a fine of not to exceed $200.00.

No person shall cast, throw or fire any squib, rocket, cracker, torpedo, grenade, cap pistol or cartridge or other combustible fireworks of any kind in the city. Provided that this section shall not be construed to apply to the use of railroad track torpedoes or other signalling devices used by railroads, nor to the use of flashlight composition by photographers or dealers in photographic supplies. Provided further that this section shall not be construed to prevent any public or private demonstration or display of fireworks of any kind, if conducted under proper police supervision, after application is made and a permit issued by the chief of the fire department for such demonstration. Such a permit shall not be granted unless such demonstration or display shall be of such a character and so located, discharged or fired as, in the opinion of the chief of the fire department, after proper inspection, shall not be hazardous to property or endanger any person.

No person shall exhibit or have in his possession with intent to give away, sell or offer for sale, or sell within the city any squib, rocket, cracker, torpedo, grenade, cap pistol, cap or cartridge or other combustible fireworks of any kind; provided, however, that this section shall not apply to the sale of any such article by wholesalers to each other or to the sale of any such article at wholesale to merchants conducting businesses entirely without the city or to the sale by wholesalers for private or public demonstrations as provided for in section 5.03.002. Provided further that nothing in this section shall be construed to apply to the sale or storage of railroad track torpedoes or other signalling devices used by railroads, nor to the sale or storage of flashlight composition by photographers or dealers in photographic supplies.

It shall be unlawful to store or sell any fireworks at wholesale except by permit from the fire chief or fire marshal, issued for a period of thirty days. An application for such permit must be filed with the fire chief or fire marshal at least ten days previous to the using thereof, and must give a detailed description of the proposed care and storage of the materials and of the structural conditions and occupancies of the building. Permits may be issued only after an inspection of the premises by the fire chief or fire marshal or his authorized agent, who shall file with the city manager a certificate of approval or disapproval and his reasons therefor.
