(a) 
It shall be unlawful for any person to burn or cause to be burned any item, including but not limited to garbage, trash, debris, building materials, trees and other vegetation, in an open fire in the jurisdiction of the city.
(b) 
In extreme cases in which the disposition of the material to be burned would cause or create a hardship, a permit may be applied for.
(c) 
The city administrator, fire chief, police chief and public works director will hear the application and shall grant the issuance of such permit.
(d) 
The permit fee shall be as established by city council, and may be waived.
(e) 
Any person who violates this section shall be guilty of a misdemeanor and upon conviction shall be assessed a fine of not less than two hundred dollars ($200.00) or more than two thousand dollars ($2000.00), plus court costs.
