No person, firm, company, corporation or association shall cast, throw or fire any squib, rocket, cracker, torpedo, grenade, cap or other combustible fireworks of any kind in the city limits.

No person, firm, company, corporation or association shall exhibit or have in his possession, with intent to give away or sell or offer for sale, any squib, rocket, cracker, torpedo, grenade, cap or other combustible fireworks of any kind in the city, provided, however, that this section shall not apply to the sale of any such article or articles at wholesale to merchants conducting business entirely without the city, or to the sale by wholesalers for private or public demonstration as hereinafter provided.

Nothing in this article shall be construed to apply to the sale, storage or the use of railroad tract torpedoes, or other signaling devices used by railroads, nor to the sale, or to prevent any public or private demonstration or display of fireworks of any kind if conducted under proper police supervision after application made and permit issued by chief of the fire department of the city for such demonstration, or display shall be of such a character, and so located, discharged or fired, as in the opinion of the chief of the fire department after proper inspection, shall not be hazardous to the property or a danger any person or persons.

Any person, firm, corporation, company or association who shall violate any of the provisions of this article, or suffer or allow the same to be violated, shall upon conviction therefor be subject to a fine in accordance with the general penalty provision found in section 1.01.009 of this code.
