All persons in the business of entertaining the general public
and charging admission fees shall as a condition precedent file an
application with and obtain from the city secretary a permit to offer
such entertainment.

The application for the permit shall be filed not less than
thirty (30) days before the first performance and shall contain the
following information:
(1) The
name of the applicant.
(2) The
address of the applicant or the applicant’s agent.
(3) The
date or dates of the proposed entertainment.
(4) The
kind or type of entertainment.
(5) The
place where the entertainment will be held.
(6) The
total off-street or highway parking spaces.
(7) The
total capacity per capita of the facility where the entertainment
will be held.
(8) The
number of restrooms available within the facility where the entertainment
will be held.
(9) An accurate
drawing or plat showing ingress and egress and showing a fire exit
plan.
(10) The
time and hours of the entertainment.

All entertainment must be held in the facility named in the
application. The city secretary or the city council shall have the
right to refuse to grant a permit when the health, safety and welfare
of the citizens of the city are endangered by traffic, inadequate
sanitation facilities, or other health hazards, possible violence,
illegal sale or use of narcotics, immoral conduct, illegal conduct
or any other similar problem or hazard.

It shall be unlawful for any person to allow, promote, conduct
or hold such entertainment without first obtaining a permit, and the
same shall constitute a public nuisance and a breach of the peace.

A violation of any provision of Sections
4.301 through
4.304 or a failure to comply with all information contained in the application shall be grounds for withdrawing or revoking the permit without a refund.

Public entertainment performed as part of city-sponsored events
will not be subject to the permit requirements herein.
