As used in this article and other articles and chapters involving the Fire Department and Emergency Medical Services, the following terms shall have the meanings indicated:
ACTIVE MEMBER
Volunteers who meet the definition of "active member" or "active life member" as established by the respective bylaws of each relevant organization, as were in effect on January 1, 1995. Probationary members are specifically excluded from this definition.
FAMILY
An active member, his or her spouse, and all natural or adopted dependent children under the age of 21 years of age, who are unmarried and reside at home. All persons must occupy the same residence.
FEES
Those charges established by the governing body of the Borough of Eatontown which are fully retained by the Borough of Eatontown as revenue. Specifically excluded is any portion of the fee which is collected by the Borough on behalf of another public entity, including but not limited to the State of New Jersey, County of Monmouth or an outside vendor, and real estate taxes.
FIRE COMPANY and FIRST AID SQUAD
The Eatontown Engine, Truck and Hose Company No. 1, now part of the Eatontown Fire Department as set forth in Chapter 20, Article V, § 20-34 of the Code of the Borough of Eatontown, and the Eatontown Volunteer Ambulance Corporation, now part of the Division of Emergency Medical Services of the Borough of Eatontown as set forth more fully in Chapter 20, Article V, § 20-35 of the Code of the Borough of Eatontown.
PATIENT CARE FACILITIES
All state-licensed nursing homes, rest homes, health maintenance organizations, assisted-living facilities, health-care facilities providing in-patient services, and other licensed or unlicensed medical care providers with the capacity to treat 10 or more outpatients simultaneously.

All incentives for Fire Company, First Aid Squad, Community Emergency Response Team and Office of Emergency Management members and families as set forth more fully in Chapter 31, Article IV, § 31-37 and Chapter 21, § 21-19 of the Code of the Borough of Eatontown.
A. 
Active member list.
(1) 
On or about January 1 of each calendar year, the Fire Department and First Aid Squad shall submit to the Borough Administrator a list of all individuals who meet the definition for active member status.
(2) 
Updates shall be provided by both organizations to the Borough Administrator on a periodic basis to add those individuals who have completed their probationary status or delete individuals who have been dismissed from the membership or who no longer meet the criteria for active member status.
B. 
On a form provided by the office of the Borough Administrator, each active member shall provide information related to the family status to assist the various municipal officials in their administration of this incentive program in order to be eligible for the benefit outlined.
C. 
All active members and their families must comply with all registration procedures and complete all application forms established by the Borough of Eatontown.

A. 
All patient care facilities located within the Borough are hereby required to own, lease, rent or have promptly available by contract sufficient appropriately staffed private ambulance services for the treatment and transport of residents and/or patients in need of nonemergency medical care. Such ambulance services shall be available 365 days per year and 24 hours per day.
B. 
In order to satisfy the requirements of Subsection A, each patient care facility subject to this article shall file proof of the availability of private ambulance services with the Borough Clerk within 60 days after final passage of this section, and on or before January 1 of each year thereafter. For purposes of this section, proof of private ambulance availability shall consist of a contract with no less than two private ambulance service providers under which such providers are obliged to respond promptly to the patient care facility.
C. 
Alternatively, if a patient care facility elects to own and operate its own ambulance(s), such proof shall consist of documentation of the make, model, year, color, serial number, license plate number, location, and staffing of such ambulance(s). As part of the proofs required under this section, the resident director, manager or authorized corporate officer of each patient care facility shall make and file with the Borough Clerk a signed certification that adequate private ambulance services are available, and that all agents and employees of such facility involved with patient care have been apprised of and trained in the use of such private ambulance services. The failure of a patient care facility to comply with the requirements of this subsection shall constitute an ordinance violation by the patient care facility and its resident director, manager, or authorized corporate officer, punishable by a fine not to exceed $2,000.
D. 
In the event that an employee or agent of a patient care facility located in the Borough takes action resulting in the dispatch of a volunteer first aid squad regulated pursuant to the provisions of § 35-6, and the responding volunteer first aid squad determines in its sole discretion that the basis for dispatch did not constitute circumstances requiring the use of basic life support or advanced life support, the volunteer first aid squad shall certify accordingly to the Borough Administrator and the private care facility shall be subject to a volunteer first aid squad dispatch fee of $750. This fee shall be payable to the Borough of Eatontown. The Borough of Eatontown may contribute fee revenue generated under this subsection to the volunteer first aid squad.

A Length of Services Awards Program (LOSAP) is hereby created in accordance with Chapter 388 of the Laws of 1997, to reward members of the volunteer firefighter and first-aid organizations for their loyal, diligent and devoted services to the residents of the Borough of Eatontown.
The LOSAP shall provide for fixed annual contributions to a deferred income account for each volunteer member who meets the criteria set forth below; that such contribution shall be made in accordance with a plan that shall be established by the Borough of Eatontown, pursuant to P.L. 1997, c. 388, and that such plan shall be administered with the laws of the State of New Jersey, United States Internal Revenue Code and this article. The LOSAP shall provide for annual contributions to each eligible member who meets the criteria as follows:
A. 
One hundred points are required for a member to be eligible for an annual contribution; and
B. 
Five years of service are required for vesting; and
C. 
The annual contribution shall be $1,150 per eligible member, per year.
The estimated annual cost of the program, based on 35 to 45 firefighters and 15 to 20 first-aid members, shall not exceed $70,000.
Each active volunteer member shall be credited with points for volunteer services provided to the volunteer fire company known as the "Eatontown Engine, Truck and Hose Co., Number 1," and/or "Eatontown First-Aid Squad," in accordance with the following schedule:
