There is hereby created and established for the city a department of police, to be directed by the chief of police, who shall be approved by a majority of the city council.

(a) 
The department of police shall be composed of the chief of police and other such certified peace officers, patrolmen, or employees as the governing body may from time to time so determine. The chief of police shall have immediate direction and control of the police department subject to the supervision of the city administrator and also subject to such rules, regulations and orders as the governing body or city administrator may prescribe.
(b) 
The chief of police may be either part or full time as the governing body may direct from time to time. The chief of police shall have all powers, rights, authorities and jurisdiction as by law vested by the state whether for police or for marshals.
(c) 
The chief of police shall receive a salary to be fixed by the governing body. The chief of police may be removed by majority vote of the governing body.

(a) 
Selection and appointment.
The members of the police department other than the chief of police shall be selected from a list of eligible candidates prepared by the chief and city administrator in accordance with the rules and regulations as the city administrator or city council may prescribe. Those members are to be appointed and approved by the city council. All officers in the police department shall remain employed as police officers at the pleasure of the city council and for such terms as the city council may so direct.
(b) 
Oath.
Each member of the department of police shall, before entering upon his or her duties, subscribe to an oath that he will faithfully, without fear or favor, perform the duties of his or her office. Salaries of each member of the police department shall be set by the city council.
(c) 
Fee for warrant or capias service.
The city council may authorize by resolution the payment, to certified municipal police officers employed by the city, for the execution of warrants or capias, a fee of office. The fee paid for warrant or capias service shall not exceed in any instance more than half of the amount the city is entitled to collect under section 102.021 of the Texas Government Code. The fee paid shall further be limited to only the first of multiple capias or warrants served by the municipal police officer on a single person.

Generally, the officers constituting the department of police of the city shall be and are hereby vested with all the power and authority given to them as police officers under the laws of the state in taking cognizance of and enforcing criminal laws of the state and the ordinances and regulations of the town within the city limits, and it shall be the duty of each such officer to use his or her best endeavors to prevent the commission within the town of offenses against the laws of the state and against the ordinances and regulations of this city. Such officers shall not receive any fee or other compensation for any services rendered in the performance of his or her duty other than the salary paid by the city, nor shall he or she receive a fee as a witness in any case arising under the criminal laws of the state or under the ordinances or regulations of the city and prosecuted in the court of the city.

The chief of police shall prescribe the uniforms and badges for the members of the police department and further direct the manner in which the members of said force shall be armed. Any person other than a member of said police department who shall wear such uniform or badges shall be subject to such fines which may be prescribed by the city council by proper ordinance.
