All ordinances authorizing the placement of traffic-control
devices, including stop signs, yield signs, and other traffic-control
signals and markings; the designation of speed zones, no-passing zones,
no-parking zones, one-way streets, and through streets; and other
ordinances regulating traffic on specific streets or parts of streets
in the city are not included in this code but are specifically saved
from repeal upon adoption of this code. Such ordinances are on file
in the city secretary’s office.
(Ordinance adopting Code)
(a) Definitions.
As used in this section:
Bicycle.
A vehicle (device) having two wheels and a tandem arrangement,
of which one or both wheels is sixteen (16) or more inches in diameter,
which is propelled solely by human power, and upon which one or more
persons may ride.
Downtown sidewalks.
That portion on both sides of Main Street between Patterson
Street and Love Street, the 100 block of S. Brewster Street, the 100
Block of N. College Street, and the 100 block of S. Patterson Street
(around the Veteran’s Memorial), all located within the corporate
limits of the city, which are designated sidewalks, or otherwise ordinarily
used for pedestrian travel.
Other vehicles.
Every device, excluding skateboards, wagons, wheelchairs,
unicycles, pushcarts, tricycles and other children’s toys, in,
upon or by which any person or property is or may be transported or
drawn upon downtown sidewalks.
Roller skates.
A skate for each foot mounted on wheels, which is propelled
solely by human power, which has no mechanism or other device with
which to steer or control the movement or direction of the skates.
Skateboard.
A single platform mounted on wheels, which is propelled solely
by human power, which has no mechanism or other device with which
to steer or to control the movement or direction of the platform.
(b) Violations.
It shall be a violation of this section
for any person to operate or propel a bicycle, skateboard, roller
skates, or other vehicle on the downtown sidewalks of the city between
the hours of 7:00 a.m. and 10:00 p.m. (Central Standard Time) Monday
through Saturday (inclusive).
(c) Penalty.
Anyone who violates any provisions of this
section commits a offense punishable by a fine of not less than one
dollar ($1.00) or more than five hundred dollars ($500.00).
