When used in this chapter, the following words and terms, unless the context indicates a different meaning, shall be interpreted as follows:
Animal control officer.
The person designated by the mayor to enforce this chapter.
Cat.
A domestic feline of either sex, including one neutered or sterilized.
Dog.
A domestic canine of either sex, including one neutered or sterilized.
Domestic animal.
Includes all species of animals com-monly and universally accepted as being domesticated.
Harboring.
The act of keeping and caring for an animal or of providing a premises to which the animal returns for food, shelter or care for a period of seven (7) days.
Local rabies control officer.
The person designated by the city council who shall have the duties as described in V.T.C.A., Health and Safety Code, section 826.017(c), which pertains to rabies control.
Owner.
Any person who has right of property in an animal or who harbors an animal or allows an animal to remain about his premises for a period of seven (7) days.
Rabies vaccination.
The vaccination of a dog, cat or other domestic animal with an antirabies vaccine approved by the United States Department of Agriculture and administered by a veterinarian licensed by the state.
Running at large.
Pertains to an animal off the premises of the owner and not under the physical, visible or audible control of the owner or his authorized representative. An animal intruding upon the property of another person than the owner shall be termed “running at large.” An animal within an automobile or other vehicle of its owner shall not be deemed “running at large.”
Stray animal.
Any animal for which there is no identifiable owner or harborer.

Any person violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine as provided in section 1.01.009 of this code. Each such violation shall be considered a separate offense.

It shall be unlawful for any owner to harbor any dog, cat, or other pet animal which by any sound or cry or other activity shall disturb the peace, comfort or property of the inhabitants of the neighborhood, and such disturbance is hereby declared to be a public nuisance.

(a) 
Dogs, cats or other animals running at large or owned or harbored in violation of this chapter or any other ordinance or law of the state shall be taken into custody by the animal control officer or other designated official and impounded. Stray animals shall be similarly impounded.
(b) 
Any animal impounded under the provisions of this section may be reclaimed within three working days (not including Saturday, Sunday or a holiday) by the owner upon the payment of all impoundment fees.
(c) 
Any dog or cat over the age of four (4) months that does not have a current rabies vaccination may not be redeemed, transferred, or adopted until it has been vaccinated as required in this chapter.
(d) 
The animal control officer may humanely destroy an impounded animal in custody after the time limit provided in this section.
