(a)

(a) 
Hours closed to public.
(1) 
All public parks within the corporate city limits, including Rudy Park, Pearson Park, Hill Park, Duffey Park, Alberta Allen Park, all Little League fields, all softball/baseball fields, all soccer fields, and all city-owned athletic practice fields, shall be closed to public use between the hours of 11:00 p.m. and 6:00 a.m., each night of the week, except as hereinafter provided.
(2) 
The public fishing area known as Perch Pond, located in the extraterritorial jurisdiction of the city, shall be closed to public use from dusk to dawn, or at any such time that the entrance gate is closed.
(b) 
Restrictions.
It shall be unlawful for any person or group to be in any public park between the hours of 11:00 p.m. and 6:00 a.m. Moreover, it shall be unlawful for any person or group to have any motorized vehicle in any public park during hours in which such parks are closed to public use. Such curfew and restrictions shall apply to the park area proper and any parking lot of the park adjacent to park grounds. Such curfew and restrictions shall not apply to public thoroughfares traversing the park grounds, if any, nor to streets adjacent to said parks, unless traffic regulations otherwise so restrict such activity and use of said streets.
(c) 
Exceptions.
Restrictions recited in subsection (b) above shall not apply to any individual or group participating in an activity or program approved for after-hours by the city parks and recreation department. Such approval must be obtained by submission of a written application to the parks and recreation department, no fewer than three (3) days before the event or activity for which after-hours approval is sought or as otherwise authorized by the director of public works.
(d) 
Signage.
The city parks and recreation department shall post signs at each park location in such place and manner as is reasonably calculated to provide adequate and proper notice to park patrons regarding these regulations, hours of operation for the parks and times during which the parks are closed to public use.
(e) 
Violations; enforcement.
Any person who is conducting or participating in an activity in the park during hours which are prohibited by and contrary to provisions of this section shall be guilty of a misdemeanor. Any police officer shall have the authority to enforce provisions of this section by removal of the violator from the grounds or area, or by the issuance of a citation or arrest of the violator.

(a) 
The public fishing area known as Perch Pond is located in the extraterritorial jurisdiction of the city (2200 S. Ora).
(b) 
The area shall be closed to public use from dusk to dawn, or at any such time that the entrance gate is closed.
(c) 
All boats, canoes, and floatation devices are prohibited.
(d) 
Throwing, disposing or placing any kind of materials or containers in the area is prohibited.
(e) 
Possession of alcoholic beverages is prohibited.
(f) 
No swimming or wading at any time.
(g) 
Domestic animals must be leashed at all times.
(h) 
Starting or creating a fire, except in a barbeque grill, is prohibited.
(i) 
Operating a motorized vehicle off designated areas is prohibited.
(j) 
Fishing is limited to bank fishing only by rod and reel (limit two (2) per person).
(k) 
Use of traps, trot lines, jug lines, nets, and seines is prohibited.
(l) 
All state fishing regulations are enforced with the following possession and bag limits:

Except as hereinafter provided, it shall be unlawful for any person to consume any alcoholic beverage (as defined in section 1.04(1), V.T.C.S. Alcoholic Beverage Code) while in any of the public parks listed in section 10.02.033 or in a public street, public alley, or public parking lot which is adjacent to the parks described in section 10.02.033.

(a) 
The possession of an open container of alcoholic beverage shall be deemed prima facie evidence of the consumption of alcoholic beverage.
(b) 
“Possession” as used herein shall include being in close proximity to an open container of alcoholic beverage and not just the physical possession of said container.
(c) 
“Open container” as used herein shall include bottles or other containers of alcoholic beverage which have had the seal broken, but have the cap or lid on the container, and shall also include containers such as cups, mugs, glasses, thermos bottles, and flasks.

Exception to the unlawful possession or consumption of alcoholic beverages in public parks will be considered under the following guidelines and provisions:
(1) 
Allow established non-profitable, charitable, or educational groups to use city parks for no more than two (2) special events per calendar year.
(2) 
Non-profitable, charitable, or educational groups must submit an application to city management indicating the date, location, time, and description of said event at least ten (10) days prior to the scheduled date.
(3) 
Alcoholic beverages will be in cans or cups. No glass containers will be permitted in the parks.
(4) 
All events must have a minimum of two (2) licensed security guards or police officers on duty at the location of the event.
(5) 
Sale of alcoholic beverages is prohibited.
