It shall be the duty of every person owning, controlling, managing, operating, leasing, renting or occupying any premises where garbage or refuse accumulates to:
(1) 
Place all garbage and rubbish from their premises in containers made available by the city.
(2) 
Place all wet garbage in suitable plastic bags and tie or secure bags properly to prevent leakage, noxious odors and access to contents by flies and vermin.
(3) 
Maintain and keep the area in and around containers clean and in a sanitary condition at all times.
(4) 
Close lids to containers after each use.

Meddling with garbage and rubbish containers in any way and scattering of the contents after being placed therein or scattering of the contents along the alleys and streets of the city or vacant lots or the premises of another within the city is prohibited and shall be punished as an offense.

The removal and disposal of garbage and rubbish by the city shall be on the following schedule:
(1) 
For residential areas, twice a week.
(2) 
For commercial establishments, as needed.

(a) 
Minimum sanitation charges.
The minimum charges for sanitation service are as set forth in the fee schedule in appendix A of this code.
(b) 
Acceptance of waste from customers outside city.
The city reserves the right to accept only those residential or commercial customers outside the city limits deemed advantageous to the city by the city manager. All monthly charges are subject to any applicable state tax and mileage fees based upon location.
(c) 
Right to discontinue service outside city.
The city reserves the right to discontinue outside-the-city service at any time, for any reason. A thirty-day notice will be given upon service discontinuation.
(d) 
Disposal rates.
Solid waste disposal rates are as set forth in the fee schedule in appendix A of this code.

The sanitation charge shall be billed to the users or customers on the same statement that water and sewer services are billed and the users or customers shall not be permitted to make payment for either utilities separately, but services for both must be paid at the same time. The city may refuse partial payment on water, sewer and sanitation charge bills and all such bills must be paid in their entirety on the due date.

If any person shall fail or refuse to pay any charge specified for sanitation services within ten (10) days after the due date, the city is hereby authorized to discontinue water services to the premises so charged for water or sanitation services.

Heavy accumulations of brick, concrete, lumber, cinders, automobile frames, trees, shrubbery, large dead animals, industrial wastes or byproducts and other bulky materials shall be disposed of by the owner or the person in charge.

All wastes or rubbish requiring special handling to comply with the state Solid Waste Disposal Act must be disposed of in accordance with said act by the owner or generator. This shall include disposal of tires, which must be split, quartered or ground before placing in refuse containers or delivery to the landfill for disposal. Refuse requiring state manifests may not be disposed of in city refuse containers.

The city will not make any collections of garbage or refuse unless the same is prepared for collection and placed as herein directed.

Placing of garbage, trash, rubbish and any article, thing or material in any street or alley or upon the vacant property of another within the city or along the streets, alleyways, fences or other thoroughfares within a distance of five thousand (5,000) feet of the city is prohibited and any act in violation shall constitute a distinct and separate offense and punished as such.

Employees of the city are allowed on the city disposal grounds at all times, and all other persons are prohibited therefrom except in the act of actual delivery of garbage and rubbish of their own.

All junk and other material on the city disposal grounds is and shall be considered as the property of the city, and no person is allowed to separate and collect such materials except under the direction of the person in charge of such disposal grounds.

The collection of garbage, junk, or other waste materials by other than the regular employees of the city is expressly prohibited, except that the provisions of this section shall not preclude the property owner or occupant from the disposition of his own rubbish and garbage, but in all such instances such removal by such person shall be deposited at the place and as directed by the person in charge of the city disposal grounds and during the hours in which such person in charge shall be on duty.

Charges for the hauling and/or disposal of extra garbage, refuse, trash or rubbish disposed of at the city landfill shall be established by resolution of the city council.
