The Township elects to provide for the payment of health benefits for certain eligible retired Township employees and their dependents.
A. 
This provision shall apply to all eligible pensioners receiving retirement benefits based upon 25 or more years of service credited in the pension fund; or in the case of appointed Municipal Attorneys first appointed on or before May 16, 1970, based upon 16 or more years of service to the Township of Nutley; except those who elected to defer retirement or a disability retirement, regardless of years of service.
B. 
Any person having at least 23 years of service to the Township of Nutley and whose position was terminated as a result of the sale of the Nutley Nursing Service to Clara Maass Health Services shall be eligible for and entitled to receive the benefits set forth in Chapter 127, Article VIII, of the Code of the Township of Nutley. Eligibility for these benefits shall be contingent upon the employee's departure from employment with the Clara Maass Health Service.
C. 
This provision shall apply to elected municipal officials who have retired and reached the age of 62 years. The elected municipal officials shall be eligible for, pursuant to N.J.S.A. 40A:10-23, the state health benefits plan or an equivalent.
A. 
All active and qualifying retired employees and spouses covered under the Federal Medicare Program will receive a refund of the amount paid for timely enrollment semiannually. All refunds will be made payable to the employee. Eligibility for Medicare reimbursement will begin on the same date that the conversion to Medicare coverage in the program became effective.
B. 
This article shall take effect immediately.
