The Board of Supervisors of Smithfield Township adopts and approves the amendment to the Articles of Incorporation of the Authority as proposed by a resolution duly adopted by the Board of the Authority, a copy of which resolution, duly certified by the Chairman or Vice Chairman and Secretary or Assistant Secretary, as appropriate, of the Authority has been submitted to the Board of Supervisors of the Township.

The amendment to the Articles of Incorporation of the Authority, which is hereby adopted and approved, shall amend, to the extent inconsistent herewith, said Articles of Incorporation, and is set forth in its entirety in Exhibit “A”[1] attached hereto and incorporated herein.

The Board of Supervisors hereby authorizes the proper officers of the Authority to execute, verify and file Articles of Amendment in the form attached hereto as Exhibit “A”1 and incorporated here in with the Secretary of the Commonwealth of Pennsylvania and to take all other action and to do all other things which may be necessary in order to accomplish such amendment of the Articles of Incorporation of the Authority in the manner herein enacted and ordained.

The Code of Ordinances of the Township of Smithfield, Chapter 1, Administration and Government, Part 5, Municipal Authority, § 1-503, Articles of Incorporation, is hereby amended to delete the existing subsection G in its entirety and to add a new subsection G which shall provide as follows:
“G. The Authority shall have the power to own, operate, and administer wastewater collection, conveyance and treatment facilities and perform wastewater planning for systems that propose to connect to a public sewer system in accordance with the Pennsylvania Sewage Facilities Act and, as necessary or desirable to perform such functions, shall additionally have the power to prepare and submit grant applications, review and approve planning modules for land development for developments proposing public sewage systems, and perform and implement studies, surveys, investigations, research, and analysis relating to wastewater planning and the collection, conveyance, treatment, and disposal of wastewater.”

The Code of Ordinances of the Township of Smithfield, Chapter 1, Administration and Government, Part 5, Municipal Authority, § 1-503, Articles of Incorporation, as previously amended as set forth in Chapter 1, Administration and Government, Part 6, Amendment to Municipal Authority Articles, § 1-604 is hereby amended to delete the existing subsection G in its entirety, and to add a new subsection G which shall provide as follows:
“G. The Authority shall have the power to undertake any project authorized by the Municipality Authorities Act, including, but not limited to, all facets of storm water planning, management and implementation, and to exercise all rights and powers necessary or convenient in connection with authorized projects, including all rights and powers set forth in the Municipality Authorities Act.”
