PERSON
Any natural person, partnership, association, corporation or other legal entity.
SPECIAL EVENT PERMIT
A permit issued on a temporary basis for an event that:
1. 
Does not exceed 10 consecutive days in length.
2. 
Is temporary; like a carnival, fire works display, festival, parade march or other activity the Supervisors deem similar in character.
3. 
Has adequate parking and traffic control for the event.
4. 
Signs would be directional only with the name of the event and a directional arrow. The sign shall not exceed eight square feet (may be doubled sided). Location of signage to be determined at meeting. Signs may be erected seven days in advance of the day the event starts and removed the day after the event ends.
5. 
Compliance with all requirements will be determined by the Supervisors. Noncompliance may jeopardize the issuance of future permits.
6. 
The Supervisors may add any conditions they feel are necessary to ensure any safety concerns are addressed.
7. 
Provide certificate of insurance naming the Township as an additional insured.

No person shall engage in any special event within the Township of Smithfield without first receiving a “special event permit” approved by the Smithfield Township Supervisors and issued by the Zoning Officer; for which a fee, which shall be for the use of the Township of Smithfield, shall be charged, established pursuant to resolution of the Smithfield Township Supervisors.

Every person desiring a permit under this Part shall first make application to the Smithfield Township Supervisors 30 days prior to event.

Upon receipt of such application and the prescribed fee, the Supervisors, if they find such application to meet all requirements, shall direct the Zoning Officer to issue a “special event permit” listing any conditions that were attached and the dates the permit is valid.

The Smithfield Township Supervisors are hereby authorized to deny, suspend or revoke any special event permit issued under this Part when they deem such denial, suspension or revocation to be beneficial to the public health, safety or morals or for violation of any provision of this Part or for giving false information upon any application for a permit hereunder. Appeals from any suspension, revocation or denial of a permit may be made to the Smithfield Township Supervisors at any time within 10 days after such suspension, revocation or denial and a hearing shall be held within 30 days of the petition for appeal. No part of a permit fee shall be refunded to any person whose permit shall have been suspended or revoked.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a district justice in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each Section of this Part which shall be found to have been violated shall constitute a separate offense.
