(a) This
section shall hereafter be known and cited as the “poster ordinance.”
(b) As
used in this section “person” shall mean and include any
person, firm, partnership, association, corporation, company or organization
of any kind.
(c) It
shall be unlawful for any person to display, erect, locate or maintain
any political posters, signs or advertisement of any character or
description upon or against any utility pole or utility structure
of any kind within the city.
(d) It
shall be prima facie evidence that the person for whose benefit the
posters are displayed is guilty of having violated this section.
(e) Any
person violating this section shall be fined an amount not to exceed
two thousand dollars ($2,000.00). Each day of violation and each location
of violation shall constitute a separate offense and shall be punishable
as herein provided.
(f) The
city manager shall instruct all department heads by written order
or otherwise, that they and members of their respective departments
shall remove all posters found in violation of this section and shall
return the material to the city manager with a notation thereon as
to the date and location found.
