The office of marshal is hereby abolished and dispensed with, and the duties of said office are hereby conferred upon a city police officer who shall be appointed as the city council shall direct, or the duties of the office of marshal of the city may be conferred by the city council upon any peace officer of the county.

The purpose and intent of this division and article is to secure the general health, safety, and welfare of the residents of the city by:
(1) 
Reaffirming the existing city police department and explicitly establishing the police department and outlining both its authority and jurisdiction;
(2) 
Reaffirming and explicitly establishing the position of chief of police to oversee and manage the city police department; and
(3) 
Outlining the duties and responsibilities of both the chief of police and peace officers.

The City of Aubrey Police Department ("department" or "city police department" is hereby reaffirmed and established as the police department of the city, at the head of which shall be the chief of police. The city police department shall be composed of the chief of police and other officers and employees as the city council may approve. The jurisdiction of the city police department shall be the corporate limits of the city and that property lying outside the city limits which is owned by the city as allowed by state law, including parks and grounds, lakes and land contiguous to and used in connection with a lake, speedways and boulevards. Additionally, the city police department is authorized to provide police services to other jurisdictions through interlocal agreements and mutual aid. Any requirement of this division may be satisfied by another department or jurisdiction if the city has an interlocal cooperation agreement or mutual aid agreement with another political subdivision to perform the requirements or if the city is the recipient of mutual aid. The police department shall perform other duties as directed by ordinance or by the city manager.

No person will be appointed as a city peace officer who has not complied with the basic requirements established by the state for peace officers and by the city acting through the chief of police under the supervision of the city manager.

(a) 
The city police department shall consist of the chief of police and such members as the city council may provide.
(b) 
The chief of police shall be appointed by the city manager after consultation with the city council.
(c) 
The chief of police shall carry out the functions of the city police department relating to public safety and enforcement of ordinances, state and federal laws; organize the city police department in conformity with the laws of the state and ordinances of the city; and shall promulgate policies, procedures, rules, directives, and orders for the administration of the department, including but not limited to discipline within the department.

Authority and duties of peace officers shall include the following:
(1) 
Individual officers constituting the city police department are invested with all the power and authority given to them as peace officers under the laws of the state, including without limitation, the Texas Code of Criminal Procedure and Texas Constitution, the United States Constitution and local law, including without limitation, city charter and city ordinances. Inherent with this power and authority is the obligation to preserve peace, to enforce the ordinances and regulations of the city, the laws of the state and of the United States, to take legal custody of offenders and to secure the citizens from violence.
(2) 
All personnel of the department shall be bound by the most current directives, orders, rules, regulations, and procedures for the operation of the city police department as may be promulgated or as hereinafter amended by the chief of police, and failure to abide thereby shall subject the violating personnel to such disciplinary action as may be determined by the chief of police within the limits of state law, city ordinances and adopted policies and procedures of the city and the department.
(3) 
Before serving as a peace officer for the city and performing law enforcement duties, all peace officers shall be required to take and sign an oath of office and meet such other requirements of law and adopted policy of the city.
