(a) 
Adopted.
That a certain document, one (1) copy of which is on file in the office of the city secretary, being marked and designated as the International Mechanical Code, 2018 edition, including appendix chapter A as published by the International Code Council, Inc., be and is hereby adopted as the mechanical code of the city, for regulating and governing the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of mechanical systems as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said mechanical code on file in the office of the city secretary are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions and changes, if any, prescribed in subsection (b).
(b) 
Amendments.
Affected sections from the 2018 International Mechanical Code are hereby amended as follows:
Section 101.l Insert: [City of Rockport, Texas].
Section 106.4.1 Insert: REVIEWED FOR CODE COMPLIANCE in place of APPROVED.
Section 106.5.1 Insert: Any person who commences work on a mechanical system before obtaining the necessary permits shall be subject to a penalty of 400% of the usual permit fee in addition to the required permit fees, but not less than $250.00.
Section 106.5.2 Insert: [Refer to fee schedule in Chapter 22, Rockport Code of Ordinances.]
Section 106.5.3 Insert: This section is hereby repealed in its entirety and replaced with: The code official is authorized to establish a refund policy.
Section 108.4 Insert: Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter or repair mechanical work in violation of the approved construction documents or directive of the code official, or of a permit or certificate issued under the provisions of this code, shall be subject to penalties as prescribed in Section 1-7, “General penalty for violations of Code; continuing violations,” City of Rockport Code of Ordinances.
