Any board or commission so designated by the city council, through the city administrator, or such other designated full-time, regularly salaried employee of the city, including the chief of police, shall have the responsibility to administer and enforce the provisions of this article.

Persons violating these provisions may be charged with creating or maintaining a public nuisance. Upon a finding that any person is violating any provisions of this article, they shall be deemed guilty of a class C misdemeanor and shall be subject to a fine of not more than two hundred dollars ($200.00). Each day of a continuing violation of any provision hereof shall be deemed a separate offense.

(a) 
The maintaining, using, placing, depositing, leaving, or permitting to be or remain on any public or private property of any of the following items, conditions, or actions are hereby declared to be and constitute a nuisance; provided, however, this enumeration shall not be deemed or construed to be conclusive, limiting or restrictive:
(1) 
The outside accumulation of garbage, rubbish, trash, refuse, junk, and other abandoned materials, appliances, bedding, bottles, boxes, broken glass, cans, cardboard, cartons, furniture manufactured for indoor use only, household appliances, machine parts, water heaters, or other things which create an unsightly appearance;
(2) 
Any condition which provides harborage for rats, mice, snakes, and other vermin;
(b) 
Designation of authority; notice of violation an order to abate [sic].

(a) 
Whenever any public nuisance, as declared in this article, exists in the city, the city administrator or a person designated by the city administrator shall give notice by personal delivery, by certified mail, with a five-day return requested, or delivered by the United States Postal Service with signature confirmation service to the owner or occupant of:
(1) 
The property on which the nuisance is located; or
(2) 
If the nuisance is located on a public right-of-way, the property adjacent to the right-of-way.
If the post office address of the last known registered owner is unknown or the city is unable to personally deliver notice to the owner, notice must be placed on the front door of the house or dwelling on the property in which the nuisance is located, or the property adjacent to the right-of-way if the nuisance is located on a public right-of-way.
(b) 
The notice must state that:
(1) 
The nuisance must be abated and removed not later than the tenth day after the date on which notice was provided; and
(2) 
If the nuisance is not abated and removed by the tenth day, the property owner is subject to a fine not to exceed $500.00.
