The purpose of this Chapter is to establish a standard for design professionals and utility companies to follow for the installation of underground utilities within the Town limits of Carrollton.

As used in this Chapter, the following terms shall have these prescribed meanings:
A tube or duct to enclose wires or cables.
Either direct burial type of mains or conduit.
Principal pipes or conduits in a system for conveying a utility to customer point of service.
Cylinder duct or tube for conveying fluids or a gas.
Cable, communications, electric, gas, sewer, water.

Warning tape manufactured for marking and identifying underground utilities shall be used in all installations, when applicable of underground utilities in the Town of Carrollton. This warning tape shall be a minimum six (6) inches wide and four (4) mills thick, continuously inscribed with a description of the utility. The warning tape is to be placed at least six (6) inches above the utility pipe/conduit being marked but no less than twelve (12) inches below surface grade. An insulated copper tracer wire no smaller than eighteen (18) AWG must also be required by the utility company, Public Service Commission rules or other codes when non-metallic pipe is used. The installation of the tracer wires must follow the color code as for tape. The tape shall be colored as follows to comply with State regulations:
Red: Electric.
Yellow: Gas, oil, steam.
Orange: Communication, CATV.
Blue: Water.
Green: Sewer.
Purple: Reclaimed water.

Water mains, sewer mains and gas mains shall be installed in trenches of adequate depth to protect them from freezing and physical damage. Protection from physical damage is achieved through proper installation, protection, or placement depth.

A.
Minimum separation distances shall be maintained between water mains, sewer mains, gas mains, and electrical conduits as follows:

Gas main separated from electric mains:
a.
Five (5) feet of separation horizontally and vertically.

In the event the minimum separation standards cannot be complied with or are impractical, then the utilities shall obtain the approval of the Mayor for any variation, and consent to such variation shall be approved, in writing, by all affected utilities.

Prior to commencing installation of any underground utilities, the utility making the installation shall notify the Mayor's office by writing or email of the date, locations, and type of installation.

A.
Any entity or person violating this Chapter shall:

Unless waived by the Town, correct any violation within a reasonable time not to exceed thirty (30) days or such longer time as approved by the Town.
2.
Be, upon conviction, subject to a fine of not less than two hundred fifty dollars ($250.00) nor more than one thousand dollars ($1,000.00) for each and every violation, in addition to any amount necessary to restore the right-of-way or repair Town facilities. Every day that this Chapter is violated shall constitute a separate offense. The Town shall have the authority to maintain civil suits or actions in any court of competent jurisdiction for the purpose of enforcing the provisions of this Chapter, and shall be entitled to recover all costs of litigation, including reasonable attorney fees and costs. In addition to any other remedies, the Town Attorney may institute injunction, mandamus or other appropriate actions or proceedings to prevent violations of this Chapter.

ROW users may face revocation or suspension of the agreed-upon franchise or right-of-way user agreement in the event of grievous or continued violation of any provision of this Chapter or the franchise or right-of-way user agreement. Revocation or suspension may result in denial of any and all right-of-way permits until the franchise or agreement is reinstated or renegotiated and approved.
