Editor's Note: This local law also repealed former Ch. 83, Bicycles, adopted 8-17-1942 by Ord. No. 45, as amended.
For the purpose of this chapter, the following definitions shall apply:
BICYCLE
A vehicle having two wheels in tandem, pedals and a handlebar, whether entirely human-powered or powered (in part or entirely) by batteries, by a gas or electric motor or by another nonhuman power source. This term shall include vehicles such as ebikes, mopeds and minibikes. This term shall also include a bicycle which has two smaller training wheels attached in the rear to aid in learning how to ride a bicycle.
CYCLE
A bicycle, tricycle or unicycle as defined herein.
MOTORIZED WHEELED VEHICLE
Any vehicle not specifically defined herein which has one or more wheels, which is powered by batteries, by a gas or electric motor or by another nonhuman power source, including but not limited to vehicles such as go-carts, golf carts and Segways.
REMOTE-CONTROLLED MINIATURE VEHICLES
A miniature model of a car, truck or other vehicle which is powered by batteries, by a gas or electric motor, or by another nonhuman powered source, and which is controlled remotely by a human operator.
SCOOTER
A vehicle consisting of a board mounted on wheels, with a handlebar used for steering and a vertical bar connecting the board to the handlebars, whether entirely human-powered or powered (in part or entirely) by batteries, by a gas or electric motor or by another nonhuman power source.
SKATEBOARD
A vehicle consisting of a board mounted on wheels, whether entirely human-powered or powered (in part or entirely) by batteries, by a gas or electric motor, or by another nonhuman power source.
SKATES
A pair of boots, or metal frame fitted to shoes, with four or more small wheels for gliding across a hard surface. This term includes both roller skates and in-line skates.
TRICYCLE
A vehicle consisting of three wheels, one large one in front and two smaller ones in the rear, pedals, a seat and handlebars, whether entirely human-powered, or powered (in part or entirely) by batteries, by a gas or electric motor, or by another nonhuman power source.
UNICYCLE
A vehicle consisting of a wheel, pedals, a seat, and a vertical bar connecting the seat to the wheels, whether entirely human-powered or powered (in part or entirely) by batteries, by a gas or electric motor, or by another nonhuman power source.
A. 
No person shall ride, propel or operate a cycle, scooter, skateboard, skates, remote-controlled miniature vehicle or motorized wheeled vehicle in the following areas of the Village (each of which constitutes a "prohibited area"):
(1) 
On the sidewalks in the Business B District;
(2) 
In a municipal parking lot or garage;
(3) 
On the steps or plaza of a public building;
(4) 
On the sidewalks along a bridge; or
(5) 
On sidewalks adjacent to schools, places of worship and residential developments for senior citizens.
B. 
This prohibition shall not apply to a person walking across a sidewalk with a cycle, scooter, skateboard, skates, remote-controlled miniature vehicle or motorized wheel vehicle in order to obtain access to or egress from private property.
C. 
This prohibition shall not apply to the parking of a cycle, scooter, skateboard, skates, remote-controlled miniature vehicle or motorized wheeled vehicle when it is being carried by its owner and not being ridden or operated on the sidewalk or other prohibited area.
D. 
This prohibition shall not apply to the use of a motorized device transporting a person who is elderly, sick or disabled, such as a motorized wheelchair.
E. 
This prohibition shall not apply to children under the age of eight who are riding a nonmotorized tricycle, scooter or bicycle in the presence of and under the supervision of an adult over 21 years old.
A. 
Every person operating or riding a cycle, scooter, skateboard, skates, remote-controlled miniature vehicle or motorized wheeled vehicle on any highway, street, sidewalk, public area and municipal parking lot or garage in the Village shall:
(1) 
Obey and observe all applicable traffic rules and regulations;
(2) 
Operate such vehicle in a manner that is safe for pedestrians;
(3) 
Wear all safety equipment required by law, including but not limited to helmets in accordance with standards established by NYS Vehicle and Traffic Law, which shall be of good fit, worn properly and fastened securely upon the head with helmet straps;
(4) 
Equip, maintain and operate such vehicle or device in compliance with the Vehicle and Traffic Law of the State of New York;
(5) 
Carry all packages, bundles and articles in a manner which allows the operator to keep at least one hand on the handlebars or control device at all times;
(6) 
Wear reflective or "day glow" safety reflectors from dusk to dawn so as to make themselves visible to vehicular traffic.
B. 
No person operating a cycle, scooter, skateboard, skates, remote-controlled miniature vehicle or motorized wheeled vehicle on any highway, street, sidewalk, public area or parking lot or garage in the Village shall:
(1) 
Operate said vehicle in a careless or reckless manner so as to endanger the safety or property of either the operator or another person;
(2) 
Wear headphones or other headgear, while operating said vehicle, which prevent or impede the hearing of external noises; or
(3) 
Carry or transport more persons on such vehicle than the number for which it is designed and equipped.
A. 
Any person 16 years of age or older who violates § 83-1 by riding, operating or propelling a cycle, scooter, skateboard, skates, remote-controlled miniature vehicle or motorized wheeled vehicle which is powered (in part or entirely) by batteries, by electric or gas motor, or by another nonhuman power source, in a prohibited area, shall be subject to a fine up to the following amounts, plus imprisonment for a period not exceeding 15 days:
(1) 
First violation: $250;
(2) 
Second violation within a twelve-month period: $350;
(3) 
Third and additional violations within a twelve-month period: $500.
B. 
Any person 16 years of age or older who violates the provisions of this chapter shall be punishable by a fine not to exceed $100 or by imprisonment for a period not exceeding 15 days, or by both such fine and imprisonment.
C. 
If a person under 16 years of age violates the provisions of this chapter and such violation occurs in the presence of such person's parent or legal guardian, then a summons for such violation shall be issued to said parent or guardian, and said parent or legal guardian shall be subject to the same penalties as set forth above in Subsections A and B.
D. 
If a person under 16 years of age violates the provisions of this chapter, and such person is not accompanied by a parent or legal guardian, then written notice shall be sent by the Village to such person's parent or legal guardian by certified mail advising such parent or legal guardian:
(1) 
Of the provision of the Village Code that was violated;
(2) 
Of the time, date and place of the violation; and
(3) 
That if the person under the age of 16 years who committed such violation commits a second such violation within a year after the date of the first such violation, then said parent or legal guardian shall be subject to the same penalties for the subsequent violation as set forth above in Subsections A and B.
E. 
The court may waive any civil fine for a person who violates the provisions of this chapter relating to the use of safety equipment and reflectors if:
(1) 
The court finds that, due to reasons of economic hardship, such person was unable to purchase such equipment; or
(2) 
Such person supplies the court with proof that, between the date of violation and the appearance date for such violation, such person purchased the requisite equipment.
Code Enforcement Officers of the Village, as well as Nassau County police officers, shall have the authority to enforce the provisions of this chapter.
