The provisions of this article imposing a time limit on parking shall not relieve any person of the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing or parking of vehicles as set forth in N.J.S.A. 39:4-138 or any other New Jersey statute or as hereinafter provided.
A.
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary emergency no-parking signs and/or meter bags are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of emergency no-parking signs and/or meter bags when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that emergency no-parking signs and/or meter bags are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
B.
The effectiveness of this section is contingent upon the signs being erected as required by law.
C.
It shall be a violation of this article to remove and/or deface any emergency no-parking sign or meter bag.
A.
Whenever snow has fallen and the accumulation is such that it covers the street or highway, an emergency shall exist and no vehicle shall be parked on the following streets or highways or portions therefrom indicated. The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent that parking will not interfere with the normal flow of traffic.

B.
Any unoccupied vehicle parked or standing in violation shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.
No person shall stop or stand a vehicle between the hours specified on any day upon any of the streets or parts of streets described below:

A.
Residents of the unit block of Centre Street may make application to the Borough of Haddonfield for permission to park up to two vehicles per household operated by them on the following listed streets of the Borough of Haddonfield without being restricted by time limit parking in § 232-28 listed above, provided that the property upon which the resident resides has no legal area in which a motor vehicle may be parked as defined in Chapter 135, Land Development, of the Code of the Borough of Haddonfield. The residents of a dwelling unit shall be limited to no more than two permits per dwelling unit.

B.
Up to seven vehicles of Tarditi Commons, 325 Lincoln Avenue, may make application to the Borough of Haddonfield for permission to park on the north side of Lincoln Avenue between the hours of 4:00 p.m. and 2:00 a.m. Monday through Saturday, from the intersection with Park Place, on the northerly curbline moving east for 140 feet without being restricted by the limits of parking listed in §232-28 above.

A.
The Chief of Police or his/her designee may establish temporary parking restrictions, as needed, for a period of time not exceeding 31 days.
B.
By resolution, the Board of Commissioners may establish temporary parking restrictions, as needed, for a period of time exceeding 31 days but no more than 180 days.
A.
No individual shall park a motor vehicle at any time on any street in the Borough of Haddonfield between the hours of 1:00 a.m. and 5:00 a.m. in the morning.

B.
The Haddonfield Chief of Police, or the Chief's designee, may approve exceptions to the above under certain circumstances as provided for below.
C. OFF-STREET PARKING INSUFFICIENT OFF-STREET PARKING
Definitions. As used in this section, the following terms shall have the meanings indicated:
A location where a vehicle parks on a legal driveway or parking area, which meets the standards set by the Borough zoning office, behind the inside line of the sidewalk so as to not interfere with the flow of pedestrian traffic.
A situation on a property upon which a resident resides that has no off-street area in which a motor vehicle may be parked or the off-street area in which a motor vehicle may be parked is too small to accommodate the number of vehicles used by the residents.
D.
Parking permits. The Chief is authorized to issue permits for overnight parking on Haddonfield streets and will make the determination whether the permit will be approved or denied according to this section. The process is to be completed in a timely manner.
(1)
Permit requirements.
(a)
The situation must meet the definition of insufficient off-street parking.
(b)
The applicant must be a full-time resident of the property in question.
(c)
The applicant's driver's license must be valid.
(d)
The vehicle for which the permit is to apply to must be legally registered.
(e)
The vehicle must have a nexus to the property, as determined by the Chief, such as the vehicle's registration is that of the property or the principal driver of the vehicle is a resident of the property.
(2)
Application process.

(a)
When a resident believes there is insufficient off-street parking on the property, the resident may apply for a permit for overnight on-street parking.
(b)
An application form, as required by the Chief, must be obtained at the Haddonfield Police Station during regular business hours.
(c)
Upon receipt of a completed application form, a Police Department representative will visit the property in question and check to see that it fits the requirements of insufficient off-street parking as set forth in this section.
(d)
The Chief will determine approval or denial. If the application is approved, the applicant will be notified by phone or mail to come to pick up the permit. If denied, the Chief will provide a written explanation with the reason for the denial.
(e)
Approved permits may be obtained from the Police Department during normal business hours after appropriate fees are paid.
(4)
Permit duration.
(a)
The permit shall be valid until December 31 of the year in which it is issued.
(b)
It is the responsibility of the permit holder to renew the permit each year.
(c)
A permit is not valid unless renewed and the yearly fee is paid.
(d)
A permit is no longer valid if there is a change in any of the conditions on which the issuance of the permit was based.
(5)
Miscellaneous provisions.
(a)
A permit may be issued for another vehicle, at no cost, upon the surrender of an existing permit, if the vehicle is a valid replacement for the vehicle the permit was initially issued for, subject to the approval of the Chief.
(b)
No refunds will be issued for any unused period of time after the annual permit is issued.
(c)
The Chief is authorized to create and implement other necessary regulations to operate the permit program that are consistent with the provisions of this section.
E.
Temporary overnight parking permission.
(1)
The Chief of Police shall have the authority to permit temporary overnight parking.
(2)
Temporary parking permission for a single night may be obtained by a system set up by the Chief.
(3)
An individual may, through an authorized method only, submit a request to the Borough no later than 12:00 a.m. for single night temporary parking permission for up to seven times per month.

(4)
Additional on-street parking permission for more than one night or more than seven times per month may be granted by the Chief or the Chief's designee due to exceptional circumstances.
F.
Conditions of all overnight parking exceptions.
(1)
An overnight parking permit or the temporary overnight parking permission does not allow any vehicle to be parked in violation of any state laws or other Borough ordinance.
(2)
The Chief may revoke these permits on a permanent or temporary basis when:
(a)
The needs of the Borough require that vehicles not be parked on a particular street for street cleaning, leaf removal, snow removal, road construction or repair, utility work, a public event or other appropriate government purpose.
(b)
The permit holder is in violation of any of the conditions that qualified that vehicle for a permit.

Applicable regulations.
(1)
All vehicles parked in any Borough parking lot listed above are subject to all provisions of this chapter and to Chapter 4 of Title 39 of the Revised Statutes, the New Jersey Motor Vehicle Code.
D.
Permit parking program.
(1)
All vehicles parked in the above lots in nonmetered spaces, between the hours of 7:00 a.m. and 6:00 p.m., Mondays through Fridays, shall be identified by use of a special permit issued by the Borough of Haddonfield, or one of its agents so authorized by the Borough, with the exception of Lot Nos. 5705 and 5706. These lots do not have permits that are issued for their use.
(2)
All persons being granted a Borough parking permit shall pay the sum of $127.50 per quarter, or $510 annually, with the exception of the following:
(a)
Lot No. 5702 shall have 21 special permits that are issued by the Haddonfield Baptist Church. These permits are for use by the Baptist Church. The cost for these permits shall be free of charge.
(b)
Residents of the Borough of Haddonfield may purchase a special permit that allows the resident to park in an assigned Borough lot. The cost for these permits shall be $15 per quarter or $60 per year.

Permits may not be used for trailers.
(c)
Borough Lot No. 5703, behind 35 Kings Highway East, shall have four special permits that are issued by Grace Church for its use. The cost of these permits shall be $75 per quarter or $300 per year.
(d)
Borough Lot No. 5729 shall be designated as school permit parking. The costs of these permits shall be $25 per month.
A.
Handicapped parking on street. In accordance with the provisions of N.J.S.A. 39:4-197, the following on-street locations are designated as handicapped parking spaces. Such spaces are for use by persons who have been issued special identification cards or plates or placards by the Division of Motor Vehicles, or a temporary placard issued by the Chief of Police. E.
Signs, pavement markings, installation and maintenance. The owners of the premises referred to in Subsections C and D shall provide and install signs and pavement markings for each parking space reserved for use by handicapped persons, which signing and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The costs of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough. The owner shall be responsible for the repair and restoration or replacement of same.

B.
In addition, metered parking shall be in areas designated by the Commissioners of the Borough of Haddonfield in all parking lots owned, leased and/or operated by the Borough of Haddonfield.
C.
Metered parking shall be in operation daily between the hours of 9:00 a.m. and 6:00 p.m. except Saturdays and Sundays. Beginning September 1, 2023, metered parking shall be in operation daily between the hours of 9:00 a.m. and 8:00 p.m. except Sundays.
D.
The metered parking shall be of the following categories, as to parking time permitted and the costs required to secure said parking time:
(1)
Street parking: $0.50 for each one-hour period up to three hours plus any applicable minimums and/or convenience fees as required.
(2)
Parking lots: $0.50 for each one-hour period plus any applicable minimums and/or convenience fees as required.
(3)
Street parking and parking lot metered parking shall be free of charge for the first 10 minutes but must still be recorded through the current Borough-approved parking mobile device application.
(4)
In accordance with N.J.S.A. 40:48-2.12t, the Borough of Haddonfield created a Senior Citizen Priority Parking Program through Resolution 2023-136 on August 28, 2023, to allow Borough of Haddonfield residents who are age 60 or older to obtain a parking permit annually to park his or her own vehicle at any metered parking spaces as opposed to requiring payment each time through the Borough of Haddonfield's current meter system.
E.
There shall be appropriate lines or markings painted upon the surface of the parking lot outlining and designating each space. Each vehicle parking adjacent to any parking meter shall be parked within said lines or markings.
F.
Violations designated.
(1)
It shall be a violation of this chapter to leave a vehicle parked in a metered space without first depositing the sum required.
(2)
It shall be a violation of this chapter for any person to cause, allow, permit or suffer any vehicle owned or operated by such person to be parked overtime or beyond the period of legal parking time established for any metered parking area.
(3)
It shall be in violation of this chapter for any person to deface, injure, tamper with, open or willfully break, destroy or impair the usefulness of any kiosk installed under the provisions of this chapter.
(4)
It shall be a violation of this chapter to deposit or cause to be deposited in any kiosk any slug, device, or metallic substance, or any other substitute for the appropriate coins of the United States of America.
(5)
Each complete hour which the vehicle remains illegally parked at a meter after the initial citation for overtime parking has been issued may be treated as a separate violation and an additional citation issued and additional penalties collected.
G.
Multiple violations for metered parking. Metered parking penalties for multiple violations shall be as follows:
(1)
A motor vehicle owner who incurs a third, fourth or fifth metered parking violation in any one calendar year, upon conviction of such a violation, shall pay twice the penalty imposed for any single violation in a single calendar year.
(2)
A motor vehicle owner who incurs six or more metered parking violations in any one calendar year, upon conviction of such violation, shall pay triple the penalty imposed for a single violation in any single calendar year.
