A.
The
provisions of the Dee Johnson Clean Indoor [Air] Act (the “act”),
New Mexico Statutes Annotated section 24-16-1 et seq., as may be amended,
are hereby adopted by the town.
B.
All
definitions contained in New Mexico Statutes Annotated section 24-16-3
are hereby adopted.

A.
It is
unlawful for a person to smoke in any indoor workplace or indoor public
place or in buses, taxicabs or other means of public transit not specifically
exempted or permitted pursuant to the act.
B.
Smoking
is prohibited near entrances, windows and ventilation systems of all
workplaces and public places where smoking is prohibited by the act.
C.
Employers
shall provide that their places of employment meet the requirements
of the act.
D.
Signs
shall be posted as indicated in the act advising persons of the existence
of smoke free areas or smoking permitted areas.
E.
Pursuant
to the act, the town fire department and/or town police department
shall enforce this chapter by issuance of a citation.
F.
Any
person may register a complaint regarding an alleged violation with
the town fire department and/or the town police department.
G.
The
town hereby adopts the violations provision and the penalties provision
of the act.
H.
The
town hereby adopts all other provisions of the act.
