The owner of land which has been excavated or any person excavating land or any person in charge of such excavation shall erect barriers or take any other suitable measures to ensure public safety within two days after such owner or person has been notified by the Selectmen or the Building Inspector that the excavation constitutes a hazard to public safety.

The penalty for violation of this chapter shall be $200 for each day such person or owner is in violation of such notice provided for in § 3-08-020 hereof commencing with the fourth day thereof.
