The primary purpose of this chapter is for the protection and preservation of the home through assurance that members of the community enjoy in their homes and dwellings a feeling of wellbeing, tranquility and privacy. The practice of picketing for or about a particular residence and dwelling causes emotional disturbance and distress to the occupants and has, as its object, the harassing of such occupant and/or occupants. The Town of Northborough is also concerned for public safety resulting from picketing which may obstruct and interfere with the use of public sidewalks and public ways of travel.
It is unlawful for any person to engage in picketing which is focused on and taking place in front of a particular residence or dwelling of any individual in the Town of Northborough.
Any person who violates any of the provisions of this chapter or any section or subsection thereof shall be guilty of an offense punishable by a fine of $100 for the first violation and $200 for the second violation and subsequent violations. Each separate violation shall constitute a separate additional offense. Notwithstanding the foregoing, any person violating any provision of this Article shall be subject to a noncriminal penalty under MGL C. 40, § 21D, of $100 for the first such violation and $200 for any subsequent violations.
