All persons engaged in handling, preparing or serving food in restaurants or food service establishments shall have a physical examination, including a chest X-ray or other tuberculin test. A record of this examination, signed by a licensed physician, shall be kept on file by the establishment owner and shall be available to the Board of Health agent prior to issuance of the annual license.

This regulation is intended to supplement Regulation 4 of the Massachusetts Department of Public Health Sanitary Code Article X concerning communicable diseases as related to food service establishments.
Failure to comply with this regulation shall be subject to a penalty as provided by M.G.L.A. C. 111, § 31.
