These regulations are promulgated under the authority of M.G.L.A. C. 111, §§ 31A and 31B.

The following definitions shall apply for the purpose of and within the meaning of these regulations:
The Board of Public Health of the Town of Northborough in Massachusetts.
The miscellaneous waste material resulting from operation of business enterprises and includes garbage, rubbish and ashes from offices and stores or the like.
Waste material resulting from the usual routine of housekeeping and includes garbage, rubbish and ashes.
All waste animal, fish, fowl, fruit or vegetable matter incident to the use, preparation and storage of food for human consumption.
The waste material discharged from the alimentary canal of humans and animals.
Waste consisting of certain discarded products incident to housekeeping and commercial enterprises, as further defined under the definitions pertaining to garbage and rubbish.
The waste material, including bones, fat, tallow and trimmings, from markets, wholesale meat houses and meat-packing plants.
Includes garbage, rubbish, offal, industrial waste, domestic waste, sewage, sludge, human or animal excrement, toxic liquid wastes, municipal waste and radioactive waste material, as well as any other substance which may be or could become offensive, annoying, unaesthetic or toxic and possibly injurious to health in any way. Nothing in this section shall mean or include the business of collection and salvage of wastepaper, cartons, crates, boxes, junk, rags or the transportation of baled papers, metal scrap from industrial plants or discarded machinery or appliances.
Includes all materials discarded for use from laboratories, commercial plants, etc., that are radioactive or emit alpha, beta or gamma rays.
The miscellaneous waste material resulting from housekeeping and ordinary mercantile enterprises and includes packing boxes, cartons, excelsior, paper, ashes, cinders, tin cans, bottles and metals.
The water-carried discharges of the human body, together with the liquid wastes from households and factories.
The precipitated solid matter produced by sewage treatment processes.
Includes the liquid drawn from cesspools, septic tanks, various acidic and alkaline liquids from manufacturing processes and radioactive liquids.
A.
No person shall remove or transport in any manner garbage, offal or other offensive substance through the streets of the Town of Northborough without first obtaining a permit for each vehicle used in such business. All such permits shall expire at the end of the calendar year in which they are issued, but may be renewed annually on application. Permits granted shall not be transferable to another person.
B.
Permits granted under this section may be revoked or suspended by the Board of Public Health for failure to comply with the applicable rules and regulations.
Each applicant for a permit issued under MGL C. 111, § 31A, as amended by the Acts of 1937, Chapter 282, shall furnish to the Board of Public Health his name, address and location of disposal area, together with a descriptive list of locations from which collections are to be made, the route from collection to disposal area and the approximate time of collection.
If a permit is issued to an applicant, it will be valid only for the area or business establishments as approved. Collections and transportation must be satisfactory to this Department at all times. No change in schedule or area will be permitted without written approval from this Department.
The words "Permit Number" and the name and number of the holder of the permit, in letters and numerals not less than two inches in height, in bold Gothic print, shall appear on the outerside of all vehicles used in transporting any of the substances governed under § 8-12-020.
All garbage, loose, wrapped or otherwise, offal, toxic waste or other offensive substances, except rubbish, collected in and transported through the streets of the Town of Northborough as before provided, shall be placed and carried in a vehicle of such construction as to be watertight and easily cleanable and maintained in such condition and which shall at all times, when not necessarily open for the purpose of depositing material collected therein, be kept securely covered. If watertight containers are used in lieu of watertight body on a vehicle, these containers shall be of metal construction and shall be securely covered. If any of the contents thereof shall be spilled upon any street or premises, it shall be the duty of the driver of said vehicle to replace these contents immediately and remove all traces thereof. Modification of this requirement in special circumstances may be obtained in writing from the Commissioner of Public Health.
Vehicles used for the transportation of rubbish shall be equipped with bodies of such construction that the rubbish will not be allowed to escape therefrom. All such vehicles shall be equipped with a suitable cover of canvas or other acceptable material for the body to prevent the rubbish from falling or from being blown from the vehicle during transportation to the disposal area.
All substances deemed to be potentially hazardous due to their radioactivity shall be transported and disposed of only in accordance with the provisions of the General Laws of Massachusetts and any local regulations or ordinances.

Whoever violates any rule or regulation made under MGL C. 111, §§ 31A and 31B, shall be punished by a fine of $50.
All prior regulations concerning the transportation of offensive substances in the Town of Northborough are hereby revoked and replaced by the above regulations.
These regulations shall be effective upon passage by the Northborough Health Board and after publication once in a daily newspaper.
