No person shall drive, back or otherwise place any motor vehicle,
snowmobile or all-terrain vehicle, as defined in the New York State
Vehicle and Traffic Law, upon any sidewalk except to cross the same
to enter adjoining premises or except when necessary to avoid conflict
with other traffic or in compliance with the directions of a police
officer.
No person shall drive, back or otherwise place any motor vehicle,
snowmobile or all-terrain vehicle, as defined in the New York State
Vehicle and Traffic Law, upon the area known as the "Heritage Trail"
except to cross the same to enter adjoining premises or except when
necessary to avoid conflict with other traffic or in compliance with
the directions of a police officer.
Every person convicted of a traffic infraction for a violation
of any provision of this section which is not a violation of any provision
of the Vehicle and Traffic Law of the State of New York shall, for
a first conviction thereof, be punished by a fine of not less than
$175 nor more than $300, or by imprisonment for not more than 15 days,
or by both such fine and imprisonment; for a second such conviction
within 18 months thereafter, such person shall be punished by a fine
of not less than $300 nor more than $400, or by imprisonment for not
more than 45 days, or by both such fine and imprisonment; upon a third
or subsequent conviction within 18 months after the first conviction,
such person shall be punished by a fine of not more than $500 or by
imprisonment for not more than 90 days, or by both such fine and imprisonment.
