The purpose of this article is to control dogs throughout the Town of Frye Island in the interest of health, safety and general welfare of its residents.
A. 
A leash shall be used to restrain a dog:
(1) 
When walking with a responsible party on public roads in the Town of Frye Island; or
(2) 
In the specified areas below:
(a) 
Golf course.
(b) 
Public buildings.
(c) 
Marina.
(d) 
Ballpark.
(e) 
Store/Ferry landing.
(f) 
Pool area.
(3) 
If the responsible party is ordered by the Animal Control Officer or a law enforcement officer to leash the dog.
B. 
The owner of any dog found in violation of this section will be subject to the civil penalties provided in this article.
A. 
Barking dogs. No person shall own, keep or harbor any dog which, by loud, frequent or habitual barking, howling or yelping, shall disturb the peace of any person or persons for more than 30 minutes.
B. 
Dogs running at large. No person shall allow a dog to run at large. "At large" shall be defined as "off the premises of the owner and not under the control of any person whose presence and attention would reasonably control the conduct of the dog."
C. 
Dangerous dogs. A dog which bites a human being in an unprovoked situation shall be considered a dangerous dog and defined as such per state animal welfare laws.
D. 
Beaches. No person shall allow a dog on any of the public beaches on Frye Island between the hours of 10:00 a.m. and 5:00 p.m.
E. 
It shall be a violation of this article for any person who owns a dog, or anyone having a dog under his or her control, to fail to immediately remove and lawfully dispose of any feces left by the dog on any of the public beaches on Frye Island, or any other public property.
A. 
Any person who shall violate the provisions of this article shall, upon the first occasion thereof, be given a written warning, which shall include the date and time it was issued.
B. 
Upon conviction of any subsequent violations within a period of six months from such warning, the person found to be in violation shall be punished by a civil penalty according to the following schedule:
(1) 
First offense: $50.
(2) 
Second offense: $100.
(3) 
Third and subsequent offenses: $200.
C. 
Any police officer, Animal Control Officer, Cumberland County Sheriff or Constable within the Town of Frye Island shall have the authority to enforce this article.
Any police officer, Animal Control Officer, Cumberland County Sheriff, or Constable within the Town of Frye Island may seize, impound, or restrain any dog violating this article or state law.
