Applications for water service must be made at the office of the Village Clerk-Treasurer on forms furnished for that purpose and must be signed by the property owner. In making application for water service, the applicant must agree to comply, and must comply with the rules and regulations as hereinafter set forth, including such revisions, additions and changes thereto as may be officially adopted from time to time by the Village Board.
No person other than the individual appointed by the Village Board to direct the operations of the waterworks system or persons in the employ of the Village and duly authorized by and under the supervision of that individual shall be permitted to tap or make any connection with any street main or distribution pipe of the waterworks system. Any other person or persons who shall tap or make any connection with any street main or distribution pipe shall incur and be liable to the payment of a penalty of $50, together with any and all costs which shall be incurred by the Village of Deposit in determining the size and adequacy of every feature of the work so performed. Water service to the premises through the connection so made shall be shut off until the penalty fee and other costs stated above shall be paid in full.
At the time application for water service is made, the person or persons making such application shall deposit with the Village Clerk-Treasurer the charges established for the tapping of the main and the furnishing of all labor and materials necessary to install the service pipe from the water main to and including the service box and curb stop at the curbline and including also the cost of pavement replacement. Should no curbline be established or defined, the service box shall be located as closely as practicable at a distance of seven feet from the edge of the street or roadway paved surface or the edge of the traveled way as established by use. Said deposit shall be refunded in the event that the application is not granted.
No person other than duly authorized personnel of the Water Department or other person who has first obtained permission so to do shall open, close or operate in any way the curb stop in the water service line. The owner of the property served by the water service shall be liable for any costs arising from damages to the curb stop, service box and/or piping on either side of the curb stop unless the curb stop is operated by employees or agents of the Village or by a person having permission of the person in charge of the Water Department.
Any injury or damage to service pipes, street mains, hydrants, valves, valve boxes or other fittings and devices; and any damage that may be caused by leakage or flow of water occasioned by such injury caused by the installation or repair of any sewer or drain line, electrical conduit or cable, telephone conduit or cable or by any excavation, embankment, paving or other construction operation shall be repaired at the expense of the contractor doing the work causing the injury or damage, or by the owner of the premises, or the person or corporation for whom such work is being done.
A.
Each premises to which water is supplied must be connected to the water main by a separate service pipe which must be laid in a straight line from the water main and enter the premises at the front and at right angles thereto. No attachment to a service pipe or any branch connection shall be made between the meter and the point of connection of the service pipe to the water main. The service pipe must be of Type K copper tubing and shall have a minimum size of 3/4 of an inch. The curb box must at all times be maintained in good condition by the property owner and must be kept level with the finished grade of the ground or the sidewalk and must be readily accessible.
B.
Whenever a new tap on the water main is desired at a location different from that of the existing service, the existing service shall be cut off at the main and the curb stop and curb box removed. The expense of this work shall be borne by the property owner. The curb stop and curb box so removed may be reused at the new location if it is of the proper size and in good condition and credit allowance for such reuse shall be made on the basis of the cost of the curb stop and curb box at the time of its installation or 75% of the price of a new curb stop and curb box at the time of the new installation, whichever is greater. The foregoing provisions, where relevant, shall apply when old services are renewed. In the event that a building to which water service is made available is demolished and if within a period of six months after the property has been substantially demolished no new structure is in the process of erection at such location as will permit of the use of the existing water service, the water service shall be disconnected at the water main and the curb stop and curb box removed at the expense of the owner of the property at the time of such substantial demolition or within such period of six months as mentioned above.
A.
Service connections 1 1/2 inches in size or larger shall be made by the use of a cast-iron tee (T) with a gate valve and cast-iron valve box located as near the point of connection to the water main as practicable. No connection shall be made to a water main which is larger in size than the water main itself.
B.
The charge to the property owner for service connections and for the cutting off and removal of curb stops and curb boxes are as set forth each year by the Village Board.

The service pipe will be required to be laid at not less than four feet below the surface of the ground at any point outside the foundation wall of the building into which the service is to be introduced. In the event that the final grade of a street or sidewalk has been officially determined and established, then the service shall be laid at a depth of not less than four feet below said established grade at all points so that when the street and walk are graded there shall be not less than four feet of earth cover over the service line at all points. A service pipe shall not be laid within six inches of any other subsurface structure, conduit or pipe, nor directly under and parallel with such subsurface structure, conduit or pipe. A service pipe laid in a sewer or construction trench shall be provided with completely adequate supports in order to protect it from settlement or lateral movement or it shall be placed on a secure bench in the side wall of the trench.
Thawing of water services or service mains by the use of electric current shall be performed only with the special permission of the person duly authorized by the Village Board to have charge and supervision of the operations of the Water Department, and through the agency of a licensed electrician, electric utility corporation or other individual having qualifications and equipment approved by the Water Department.
A.
When leaks occur in that portion of the service pipe between the center of the curb stop and the property served, the leaks shall be repaired within 48 hours after notice has been given the owner of the premises and/or tenant so to do. If the leak has not been repaired within 48 hours, the Village Board reserves the right to discontinue the water supply to the premises until repairs have been made. The entire cost of such repairs shall be met by the owner.
B.
All plumbing connections in the service line and in the piping and fixtures within buildings shall be of sufficient strength to withstand a pressure of not less than 125 pounds per square inch.
The Water Department shall not be legally required to supply water at a greater pressure than that necessary to deliver the water into the basement of buildings. The Water Department, however, will make an effort to maintain a pressure sufficient to supply water to the second floor levels.
Where flushometers, suction tanks or other fixtures or piping are equipped with quick closing valves and are supplied by direct pressure in excess of 50 pounds per square inch, an air chamber of an approved type must be installed within two feet of the house control valve or water meter. Where water-hammer conditions exist in any installation, regardless of the pressure, an air chamber of an approved type must be installed where and as directed by the Water Department. A pump (except fire pumps) with an intake diameter of three inches or larger shall not be connected directly to the Village mains. All pumps shall be equipped with a surge or suction tank and with such devices as will assure the water mains against damage due to surges and/or water hammer.
A.
No connection of the piping (either inside or outside of the premises) serving water supplied by the Village water mains will be permitted with any other source of supply.
B.
The penalty for violation of this section will be the shutting off at the water main of the water supply to the premises and the charging of the owner of all expenses of every nature incidental thereto. Water service will not be restored until violations have been removed and all costs in connection therewith paid. Such a violation is a violation of the New York State Sanitary Code.[1]

A.
As necessity may arise in the case of breaks in water mains or other emergencies of a similar nature, including the necessity for making repairs, connections, extensions and/or the installing and repairing of consumer services, the Water Department shall have the right and authority to temporarily shut off the water supply in order to perform the necessary work.
B.
The Water Department will use, if possible, all reasonable and practicable means to notify the consumers in advance of such discontinuation of water service.
C.
However, the Water Department shall not be liable for any inconvenience suffered by the consumer, or for any damage which may result to the consumer's piping, fixtures, appliances, etc., resulting from the shutting off of the water supply for any purpose whatever, whether or not previous notice has been given.
D.
The Water Department will not be liable in any case for any claim against it at any time for the interruption of water service, lessening of the water supply, inadequate water pressure or any other cause which may be beyond its control.
E.
Water service to a consumer may be shut off only by a Water Department employee or its agent for the purpose of inspection or for the making of repairs or alterations to water mains, meters, pipes, valves or other appurtenances. No other person shall open, close or tamper with any valve, valve box or valve box cover, or any other equipment of the Village water supply system.
The use of water is permitted subject to such conditions or reservations as the Water Department may in its sole discretion consider to be reasonable. The Water Department reserves the right to restrict or prohibit extraordinary use of water if water supply conditions so require.
A.
No installation of refrigeration and/or air-conditioning equipment shall be installed on any premises supplied from the Village system until a written permit has been issued by the Water Department to the owner on whose premises the installation is to be made.
B.
Applications for permits for refrigeration and/or air-conditioning equipment shall set forth the details of the equipment to be installed and the conditions under which it is to operate.
A.
No person other than one properly authorized so to do shall take water from any public fire hydrant without first obtaining a permit, in writing, from the Water Department. In the event that the Water Department grants such permission, the user shall assume all liability for damage to the hydrant and shall pay all costs for water used and other costs in connection with such use, including services rendered by agents and employees of the Water Department.
B.
No water shall be taken from a private fire hydrant for any purpose other than for extinguishing of fires, except for the purpose of testing firefighting equipment.
Water will be turned off at the written request of the owner of any premise but no deduction in the minimum charge for any time less than one billing period will be allowed. A charge in an amount set from time to time by resolution of the Village Board will be made to the owner of the premises at the time the water is turned on, which shall be done only at the written request of the owner of the premises.
The Village Clerk-Treasurer shall have the power and authority to collect all charges and fees and to impose and collect such penalties as are herein provided.
The Village Board reserves the right to change the rules, regulations and rates for use of water from time to time as conditions may require.
