The qualified voters in an area or property owners of an area wishing to be included in the extraterritorial jurisdiction (ETJ) or in the city limits must submit the following documents:
(1)
A written petition that is:
a.
Signed by each owner of land in the area; or
b.
If the area has a population of less than 200, signed by more than 50 percent of the registered voters of the area, or, if the registered voters of the area do not own more than 50 percent of the land in the area, the petition is signed by more than 50 percent of the owners of the land in the area; or
c.
If the area has a population of at least 200, signed by more than 50 percent of the land owners of land in the area.
(2)
The petition will include:
a.
An attestation that the land is contiguous and adjacent to the City of Simonton, Texas; and
b.
An attestation that the petition is signed by each and every owner of the land, or more than 50 percent of the registered voters, or more than 50 percent of the land owners, whichever is accurate; and
c.
Contain a metes and bounds description of the property; and
d.
Contain a survey or map showing the area under petition; and
e.
An attestation that the property is not appraised for ad valorem tax purposes as land for (1) agricultural management use; or (2) wildlife management use; or (3) timber land; and
f.
The landowner declines to make a development agreement with the city.
(3)
A check in the amount required to cover legal and clerical expenses, document and map preparation. Such amount shall be as currently established or as hereafter adopted by resolution of the city council from time to time.
