There is hereby created in Cummings Township a Planning Commission which shall have all the powers and duties conferred upon it hereinafter as well as any other powers and duties which may be conferred upon it by laws, resolutions or regulations now in force or subsequently enacted by the Commonwealth of Pennsylvania or by Lycoming County.

The Cummings Township Planning Commission shall consist of five members, all of whom shall be appointed by the Board of Supervisors and all of whom shall serve without compensation, except that they shall be reimbursed for necessary and reasonable expenses incurred in carrying out their commissioned duties. Insofar as the initial appointees are concerned, the terms of members first appointed pursuant to this chapter shall be so fixed that no more than two shall be reappointed or replaced during any calendar year. As the term of each original appointee expires each new appointment or reappointment shall be for a full term of four years. In the event any vacancy occurs on the Commission, upon notification thereof by the Chairman of the Planning Commission the Board of Supervisors shall appoint a replacement to serve for the balance of the unexpired term.

All the members of the Planning Commission shall be residents of Cummings Township and at least three of the five members shall not be officers or employes of the Township.
The Planning Commission shall elect its own Chairman, Vice Chairman and Secretary and may create and fill such other offices as it may deem necessary. All officers shall serve annual terms and may succeed themselves. The Commission may further make and alter bylaws, rules and regulations to govern its own proceedings so long as these are consistent with all ordinances of Cummings Township and the laws of the Commonwealth of Pennsylvania. The Commission shall keep a full record of its activities and shall submit to the Board of Supervisors by March 1 of each year an annual written report of its previous calendar year's activities.

The Planning Commission shall have the following powers and duties as specifically set forth in Section 209.1 of the Pennsylvania Municipalities Planning Code, hereinafter referred to as the "Act," and in 53 P.S. § 10209.1:

The Planning Commission shall have all the powers and duties conferred and imposed upon it as set forth in Article II of the Pennsylvania Municipalities Planning Code, established by the Act of July 31, 1968, P.L. 805, No. 247, as amended and reenacted (53 P.S. § 10201 et seq.).

In the performance of its powers and duties, any act or recommendation of the Planning Commission which involves engineering consideration shall be subject to review and comments of an engineer, which shall be incorporated and separately set forth in any report, written act or recommendation of the Planning Commission.
The Planning Commission may, with the consent of the Board of Supervisors, accept and utilize any funds, personnel or other assistance made available by the county, the commonwealth or the federal government or any of their agencies, or from private sources. The Commission may further cooperate with other adjoining townships and their Planning Commissions for the purpose of doing regional comprehensive planning and may seek outside financial assistance for such planning efforts in cooperation with such other townships and Planning Commissions. The Planning Commission may also seek the assistance of the Lycoming County Planning Commission and its staff and may request the Board of Supervisors to employ administrative and/or technical services from outside sources where such agreements are required by law to be entered into by the municipality involved rather than by the Planning Commission, or in cases where both the municipality and the Planning Commission must be applicants.
All other provisions of the Pennsylvania Municipalities Planning Code related to Planning Commissions not specifically covered or referred to by the provisions of this chapter shall be applicable to the conduct of the Cummings Township Planning Commissions business and any subsequent amendments, deletions or alterations affecting Article II of said Code shall likewise affect the operation of this Planning Commission.
This chapter may be amended at any time by action of the Board of Supervisors in accordance with the applicable provisions relating to the amendment of ordinances generally in Second Class Townships.
