A. 
The Building Department of the Village is hereby established, and the executive official in charge thereof shall be known as the "Building Inspector," who shall be appointed by the Village Manager pursuant to New York State Civil Service Rules and Regulations. The Village Manager may also appoint an Assistant Building Inspector, provided that said individual is a certified Code Enforcement Officer pursuant to the requirements of the laws of the State of New York or shall obtain said certification with 12 months of appointment.
B. 
To be eligible for appointment, the Building Inspector shall be a graduate of a recognized college or university with a bachelor's degree in engineering or architecture and shall have had at least four years' experience either as a licensed professional engineer or registered architect in the design, construction or supervision of buildings and structures, or such training and experience as a qualified municipal building and plumbing inspector as may be considered equivalent by the Village Manager.
C. 
The Building Inspector shall:
(1) 
Administer and enforce all provisions of the Uniform Code, the Energy Code and this chapter;
(2) 
Receive, review, and approve or disapprove applications for building construction required by this chapter;
(3) 
Issue permits and furnish the prescribed certificates;
(4) 
Examine premises for which permits have been issued, and make the necessary inspections and issue the necessary orders to enforce the provisions of this chapter which relate to the prevention of fires and to the public safety, health and general welfare;
(5) 
Issue stop-work orders;
(6) 
Review and investigate complaints;
(7) 
Maintain records;
(8) 
Collect fees as set by the Village Board of Trustees;
(9) 
Pursue administrator enforcement actions and proceedings;
(10) 
In consultation with the Village Attorney, pursue such legal actions and proceedings as may be necessary to enforce the Uniform Code, the Energy Code or this chapter;
(11) 
Issue rules where necessary to interpret or apply the provisions of this chapter;
(12) 
Make, or cause to be made, investigations and tests of new materials and methods of construction; and
(13) 
Exercise all other powers and fulfill all other duties conferred upon the Building Inspector by this chapter.
D. 
In addition to such duties as may be prescribed by law and those which may be assigned or required by the Building Inspector, the Assistant Building Inspector shall inspect the construction and alteration of all plumbing work performed in the Village for the sole purpose of ascertaining whether such work complies with the provisions of this chapter and to keep a report of the results of such inspections.
In the discharge of his/her duties, the Building Inspector or his/her authorized representative(s) shall have the authority to request entry to any building, structure or premises in the Village at any reasonable hour to enforce the provisions of this chapter. If denied entry by the owner or occupant, the Building Inspector or his representative is authorized to apply for an administrative search warrant in Scarsdale Village Court to permit inspection.
All inspectors, plan reviewers and code enforcement officers or other authorized representative(s) are hereby relieved from all personal liability for any damage that may accrue to persons or property as the result of any act required or permitted in the discharge of their official duties.
