The Building Inspector may, in his/her discretion, issue a building permit pursuant to this chapter, subject to the condition that a New York State licensed professional engineer or registered architect be employed by the owner or builder to supervise all field and shop work done under the permit to see that the work as installed conforms to the approved drawings and specifications and forthwith upon its completion to file with the Building Inspector an affidavit or affidavits that all inspection requirements of this chapter have been met and that the work has been completed in accordance with the approved drawings and specifications and in compliance with the provisions of this chapter. In such case, the Building Inspector may rely upon such affidavit or affidavits as evidence that such building conforms substantially to the approved drawings and specifications and the requirements of this chapter applying to buildings of its type of construction and use classification. Filing a false affidavit shall constitute a crime and shall be punishable under New York State law.
The Fire Chief or designee shall inspect, or cause to be inspected, all buildings and premises, except the interiors of one- and two-family dwellings, no less frequently than two times a year for the purpose of ascertaining and causing to be corrected any hazards of fire, explosion or toxic gases or any violation of the provisions of this chapter or of any other law or regulation of the Village of Scarsdale or other governmental agency having jurisdiction with respect to such hazards.
The holder of a building permit shall request and, except as otherwise set forth, the Building Inspector will make the inspections required by this chapter.
A.
Whenever possible, requested inspections shall be made within 24 hours of the Building Inspector's receipt of such request, exclusive of Saturdays, Sundays and holidays.
B.
Construction shall not proceed beyond the point of such inspections until approval of the Building Inspector has been obtained.
C.
The Building Inspector may accept written and signed inspection reports of a New York State licensed or registered architect or licensed professional engineer in affidavit form.
The following elements of the construction process shall be inspected, where applicable:
A.
Worksite prior to the issuance of a building permit;
B.
Footing and foundation;
C.
Preparation for concrete slab;
D.
Framing;
E.
Structural, electrical, plumbing, mechanical, fire-protection, and other similar service systems of the building;
F.
Fire-resistant construction;
G.
Fire-resistant penetrations;
H.
Solid-fuel-burning heating appliances, chimneys, flues, or gas vents;
I.
Inspections required to demonstrate Energy Code compliance, including but not limited to insulation, fenestration, air leakage, system controls, mechanical equipment size, and, where required, minimum fan efficiencies, programmable thermostats, energy recovery, whole-house ventilation, plumbing heat traps, and high-performance lighting and controls;
J.
Installation, connection, and assembly of factory manufactured buildings and manufactured homes; and
K.
Final inspection after all work authorized by the building permit has been completed.
After excavation has been made, the Building Inspector shall make an inspection of the foundation bed and footing forms and may require certification from a New York State registered architect or licensed professional engineer of soil bearing capacity and form work.
The construction of a building or structure shall not proceed above the first floor level or beyond until the exterior corners and dimensions from property lines are delineated on a plot plan prepared by a licensed land surveyor and submitted for the review and approval of the Building Inspector, as conforming to all applicable provisions of Chapter 310, Zoning, of this Code, unless in the opinion of the Building Inspector the work is of a minor nature.
The Building Inspector shall make an inspection of all lathing and concrete reinforcement after it has been installed in place and before plaster is applied or concrete is poured.
The Building Inspector shall make an inspection after all insulation and vapor-barrier material has been installed and before interior wall, ceiling or other coverings are applied.
The Building Inspector shall make an inspection of the framework after all structural members are in place but prior to the application of any lath, plaster or other fire protection or the application of any finish materials.
The Building Inspector shall make an inspection after all framing, including the roof tier, bracing and firestopping, has been completed and all piping and rough plumbing are in place and prior to the application of any interior wall or ceiling covering.
The holder of a building permit shall file an application for an electrical inspection with the Village for an inspection with a New York State authorized agency that will have such electrical inspections performed by a duly authorized inspector. Such application will be made in a timely manner so as to permit inspections to be made in accordance with the normal procedures of the New York State authorized agency for the type of building under construction.
When required by the provisions of § 132-43 for reinforced concrete structures, the supervision of such work shall include approval of preliminary concrete design mixes, inspection at concrete batching plant, preparation of test cylinders, review of testing laboratory reports, slump tests, inspection of forms and shoring, inspection of all structural and reinforcing steel, depositions of concrete and methods of curing and frost control.
The Building Inspector shall make a final inspection upon completion of construction of a building or structure and prior to the issuance of a certificate of use and occupancy. A final survey prepared by a New York State licensed surveyor is required prior to issuance of a certificate of use and occupancy, unless, in the opinion of the Building Inspector, such construction work is of a minor nature. The final survey is to include all improvements; setbacks; first-floor, second-floor and midpoint-of-roof elevations; and topographic information to indicate compliance with approved plans.
At the discretion of the Building Inspector, a remote inspection may be performed in lieu of an in-person inspection when, in the opinion of the Building Inspector or such authorized inspector, the remote inspection can be performed to the same level and quality as an in-person inspection and the remote inspection shows to the satisfaction of the Building Inspector or by such authorized inspector that the elements of the construction process conform with the applicable requirements of the Uniform Code and Energy Code. Should a remote inspection not afford the Building Inspector or such authorized inspector sufficient information to make a determination, an in-person inspection shall be performed.
After inspection, the work or a portion thereof shall be noted as satisfactory as completed, or the permit holder, or their duly authorized designee, shall be notified as to the manner in which the work fails to comply with the Uniform Code or Energy Code, including a citation to the specific code provision or provisions that have not been met. Work not in compliance with any applicable provision of the Uniform Code or Energy Code shall remain exposed until such work shall have been brought into compliance with all applicable provisions of the Uniform Code and the Energy Code, reinspected, and found satisfactory as completed.
Fees for construction inspections shall be established by resolution of the Village Board of Trustees in accordance with § 132-7. All fees shall be paid prior to or at the time of each inspection performed pursuant to this section.
