A certificate of use and occupancy shall be required for all buildings and structures for which a building permit has been issued pursuant to this chapter, and for all structures, buildings, or portions thereof which are converted from one use or occupancy classification or subclassification to another. Permission to use or occupy a building or structure, or portion thereof, for which a building permit was previously issued shall be granted only by issuance of a certificate of use or occupancy. Failure to obtain a certificate of use and occupancy shall be a violation of this chapter.
No building or structure hereafter erected shall be occupied or used in whole or in part for any purpose until a certificate of use and occupancy has been issued by the Building Inspector certifying that such building or structure conforms substantially to the approved plans and application and the requirements of this chapter for buildings and structures of its use classification and type of construction or as certified pursuant to § 132-43 of this chapter.

No certificate of occupancy shall be issued for any residential construction which received site plan approval from the Planning Board unless a final survey, including topography, prepared by a New York State licensed surveyor, has been provided, along with a certification, signed by the licensed architect or engineer and property owner, that all construction was performed in accordance with the approved site plan. To the extent there are any modifications from the approved site plan, justification must be provided along with written verification from the Village staff that the modification did not require site plan amendment and was approved by the Village Engineer or Building Inspector. The final certificate of occupancy shall not be issued until the Village Engineer and Building Inspector have reviewed and approved the final survey.
No building or structure hereafter altered for which a building permit is required and which was vacant during the progress of the alteration shall be occupied or used in whole or in part, for any purpose, until a certificate of use and occupancy has been issued by the Building Inspector certifying that the work for which the permit was issued has been completed substantially in accordance with the approved plans and application and the provisions of this chapter applying to such alteration. When the occupancy or use of the building or structure has continued during the work of alteration, such occupancy and use shall be terminated not more than 30 days after completion of the alterations, unless a certificate of use and occupancy has been issued.
A. 
Upon request of a holder of a building permit or by action of the Building Inspector, a temporary certificate of use and occupancy may be issued for a building or structure or part thereof before the entire work covered by such permit has been completed. However, in no event shall the Building Inspector issue a temporary certificate of use and occupancy unless the Building Inspector determines:
(1) 
That the building or structure, or the portion thereof covered by the temporary certificate of use and occupancy, may be occupied safely;
(2) 
That any required fire and life safety components, such as fire protection equipment and fire, smoke, carbon monoxide, and heat detectors and alarms are installed and operational; and
(3) 
That all required means of egress from the structure have been provided.
B. 
The temporary certificate of use and occupancy shall specify the portion or portions of the building or structure that may be occupied pursuant to the temporary certificate of use and occupancy. The Building Inspector may include in a temporary certificate of use and occupancy such terms and conditions as he or she deems necessary or appropriate to ensure the health and safety of the persons occupying and using the building or structure and/or performing further construction work in the building or structure. A temporary certificate of use and occupancy shall be effective for a period of time, not to exceed 90 days, which shall be determined by the Building Inspector and specified in the temporary certificate of use and occupancy. Upon written request, an applicant may renew a temporary certificate of use and occupancy for no more than two additional periods of 30 days each. During the specified period of effectiveness of the temporary certificate of use and occupancy, the permit holder shall undertake to bring the building or structure into full compliance with all applicable provisions of the Uniform Code and the Energy Code. The temporary certificate of use and occupancy shall include the information set forth in § 132-64D.
A. 
Upon written request of the owner of an existing building or structure, for which construction began after July 31, 1923, the Building Inspector shall issue a certificate of use and occupancy, provided that there are no apparent violations of this chapter or other pertinent state or local laws and related regulations or orders of the Building Inspector and it is established after inspection and investigation that the alleged use of the building has heretofore existed. Nothing in this chapter shall require the removal, alteration or abandonment of or prevent the continuance of the use and occupancy of a lawfully existing building unless the use thereof endangers public safety or welfare.
B. 
Structures for which construction began before August 1, 1923, do not require certificates of use and occupancy.
A. 
The Building Inspector shall issue a certificate of use and occupancy if the work which was the subject of the building permit was completed in accordance with all applicable provisions of the Uniform Code and Energy Code and, if applicable, that the structure, building or portion thereof that was converted from one use or occupancy classification or subclassification to another complies with all applicable provisions of the Uniform Code and Energy Code.
B. 
Application for such a certificate shall be made on a form furnished by the Building Inspector and shall be accompanied by the fee as established by resolution of the Board of Trustees, by a sworn statement by a person familiar with the work to the effect that, to the best of his/her knowledge and belief, the work has been completed in accordance with the approved application and drawings and all amendments thereto and is safe for the use and occupancy specified, and, where applicable, by an affidavit required pursuant to § 132-43 of this chapter. Further, an affidavit of final cost for all work completed shall be submitted by the responsible party.
C. 
The Building Inspector, or his or her designee, shall inspect the building, structure, or work prior to the issuance of a certificate of use or occupancy. In addition, where applicable, the following documents, prepared in accordance with the provisions of the Uniform Code by such person or persons as may be designated by or otherwise acceptable to the Building Inspector, at the expense of the applicant for the certificate of use and occupancy, shall be provided to the Building Inspector prior to the issuance of the certificate of use and occupancy:
(1) 
A written statement of structural observations and/or a final report of special inspections;
(2) 
Flood hazard certifications;
(3) 
A written statement of the results of tests performed to show compliance with the Energy Code; and
(4) 
Where applicable, the affixation of the appropriate seals, insignias, and manufacturer's data plates as required for factory manufactured buildings and/or manufactured homes.
D. 
A certificate of use and occupancy shall contain the following information:
(1) 
The building permit, if any;
(2) 
The date of issuance of the building permit, if any;
(3) 
The name (if any), address and tax map number of the property;
(4) 
If the certificate of use and occupancy is not applicable to an entire structure, a description of that portion of the structure for which the certificate of use and occupancy is issued;
(5) 
The use and occupancy classification of the structure;
(6) 
The type of construction of the structure;
(7) 
The occupant load of the assembly areas in the structure, if any;
(8) 
Any special conditions imposed in connection with the issuance of the building permit; and
(9) 
The signature of the Building Inspector issuing the certificate of use and occupancy and the date of issuance.
E. 
Revocation or suspension of certificates. If the Building Inspector determines that a certificate of use and occupancy, or a temporary certificate of use and occupancy, was issued in error or on the basis of incorrect information, and if the relevant deficiencies are not corrected to the satisfaction of the Building Inspector within such period of time as shall be specified by the Building Inspector, the Building Inspector shall revoke or suspend such certificate.
