The Village of Pelham hereby finds that unlimited
use of lawn maintenance equipment powered by internal-combustion engines,
particularly so called "leaf blowers," impairs the economic and social
welfare, health, peace and quality of life of persons residing in
Pelham. The purpose of this Article is to minimize the adverse impact
of such equipment and yet permit its use within the Village. The provisions
of this article shall be liberally construed for the accomplishment
of that purpose.
Lawn maintenance equipment powered by internal-combustion
engines, including, but not limited to, lawn mowers and leaf blowers,
shall not be operated in the Village of Pelham, except at the following
times:
A. On weekdays between 8:00 a.m. and 5:30 p.m., except
grass may be cut with an internal-combustion engine lawn mower by
an occupant of the premises where it is being cut on weekdays between
the hours of 5:30 p.m. and 8:00 p.m.
B. On Saturdays between 10:00 a.m. and 5:00 p.m.
C. On Sundays and holidays between 12:00 p.m. and 4:00
p.m.

A. No person
shall operate a gas-powered leaf and lawn blower for any purpose except
during March 15 to April 30 and October 15 to December 15.
B. The permitted
hours of use are Monday through Friday from 8:30 a.m. to 5:30 p.m.
and Saturday from 10:00 a.m. to 5:00 p.m.
C. All leaf-blower
use is prohibited on Sundays, except by residents on their own property
between 12:00 p.m. and 4:00 p.m.
It shall be a violation hereof to operate any
lawn maintenance equipment powered by an internal-combustion engine
in the Village of Pelham without a properly functioning muffler.

The owner, as defined in §
54-8 of Chapter
54 of the Code of the Village of Pelham, of the premises where a violation of this article has occurred as well as the landscaper, gardener, contractor or any other person who violates this article or is an accessory to the violation are liable for the violations and subject to the penalties set forth in Article
III of Chapter
1 of the Code of the Village of Pelham.
The Mayor or the Village Administrator is authorized to suspend any one or more of the provisions of this Article
V for a period of 24 hours whenever the Mayor or the Village Administrator determines that an emergency situation exists in the Village. Such suspension may be renewed each day during the continuance of such emergency.
