If the owner, owner's authorized agent, or occupant fails
to abate a nuisance or otherwise comply with an order or notice under
this code within five days of the deadline given by such order or
notice for compliance, or within five days of an unsuccessful appeal
of the same, the City may proceed to perform the required work to
abate the nuisance or otherwise remedy the conditions stated in the
order or notice. The City may perform such work, or hire a third party
to perform it.
If the City incurs costs or expenses in performing work to abate
a nuisance or otherwise remedy any condition stated in an order or
notice under this code, such costs or expenses shall be paid by the
owner of the premises involved. If unpaid for more than two months
after such work is done, the City may either (A) levy and assess the
costs and expenses upon the premises so benefited as a special assessment,
or (B) recover in a civil action the costs and expenses of the work
upon the premises and adjoining streets and alleys.
