(a)
Adoption.
A certain document, on file in the office of the city secretary, being marked and designated as the North Central Texas Public Works Construction Standards, 2004 edition (containing section I, “Standard Specifications,” including divisions 100 through 800; appendix A, “Model Forms” and index; and section II, “Standard Drawings,” including divisions 1000 through 6000), as published by the North Central Texas Council of Governments, is hereby adopted as the city public works construction standards code.
(b)
Deviation from specifications.
Any deviation from the standards adopted by subsection (a) must be approved by the engineer of record and the city council.
(c)
Penalty.
Any person, firm or corporation violating any provision of this section shall be deemed guilty of a misdemeanor and upon conviction shall be subject to a fine in accordance with the general penalty provided in section 1.01.009 of this code for each offense; providing, however, where a different penalty has been established by state law for such offense the penalty shall be that fixed by state law; and every day any offense is continued shall constitute a new and separate offense.
