It shall be unlawful for any person or persons to park, place, or cause to be parked or placed any obstruction of all types and descriptions within any right-of-way of the Borough of Myerstown, including streets, roads, water, and sewer rights-of-way, and including any stormwater facilities, drainage swales, and stormwater easements located in the Borough of Myerstown, Lebanon County, Pennsylvania. Only grass shall be permitted within any of these rights-of-way, stormwater facilities, drainage swales, and stormwater easements.

The Borough of Myerstown shall have the authority to remove or to order the removal of any obstruction that is parked or placed in any of the said rights-of-way, stormwater facilities, drainage swales, and stormwater easements. A person or persons who placed or caused the obstruction shall be responsible for costs of removal.

Any person or persons who has caused damage to any rights-of-way of the Borough of Myerstown, or to the stormwater facilities, drainage swales, and stormwater easements located within the Borough of Myerstown, Lebanon County, Pennsylvania, shall be liable to the appropriate body for the costs of restoration.

The Borough Council of the Borough of Myerstown may approve by resolution obstructions within the areas described herein when the Council determines that the obstruction will not interfere with the intended use.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not less than $100 nor more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each Section of this Part which shall be found to have been violated shall constitute a separate offense.

The Borough of Myerstown may bring an action in the Court of Common Pleas of Lebanon County, Pennsylvania, as an equity action requiring any person or persons to comply with the requirements of this Part. In any such proceedings, the person or persons violating this Part shall be responsible to pay the court costs, the attorney’s fees of the Borough of Myerstown, together with such other penalties as authorized by this Part.
