As used in this article, the following terms shall have the meanings indicated:
ADAMS STREET PLAZA
The parking lot now located between Adams Street and the J.R. Roof alley, running parallel with Spring Street and located to the rear of the store buildings facing on Spring Street, and designated on the official Tax Maps of the Town of Newton at Block 711 Lots 26A, 27A, 29A, 30A and 31A.

CENTRAL PLAZA
The parking lot located on Trinity Street opposite the present municipal building and designated on the official Tax Maps of the Town of Newton as Block 717, Lots 27 and 28.

MAIN STREET PLAZA
The parking lot located on Main Street directly to the rear of the Kymer Building and the Newton Trust Company Building.
WESTERN PLAZA
The parking lot located on Trinity Street between Moran Street and Water Street (U.S. Highway No. 206).

When any vehicle is parked in any metered space in any of the public parking lots enumerated in § 307-34 between the hours of 8:00 a.m. and 6:00 p.m. on all weekdays and Saturdays, upon entering the parking lot, the operator of the vehicle shall deposit a proper United States coin, coins or paper currency in the denominations set forth in § 100-15B..

Vehicles may be parked in metered spaces in any of the above mentioned parking lots between the hours of 6:00 a.m. to 4:00 a.m.; however, vehicles shall be permitted to remain in a limited portion of the parking lots between the hours of 4:00 a.m. and 6:00 a.m. as listed in Schedule IV-B (see § 307-53) after first obtaining a parking pass and paying the required fee as outlined in § 100-15.
A. 
No owner or operator shall stand or park a vehicle in any of the aforementioned parking lots at any time on any weekday between the hours specified in § 307-35 of the Town Code without depositing sufficient coin, coins or paper currency in the designated meter to cover the period during which the vehicle shall remain standing or parked. All-day parking passes may be used in lieu of depositing coin, coins or paper currency. The provisions for this chapter shall not be applicable on Sundays or any legal holiday or the day designated for the observance of any holiday, except as otherwise provided in § 307-40 of the Town Code.

An annual merchant pass will be available for Lot No. 4 Central Plaza and Lot No. 3 Western Plaza parking lots only, for business owners on Spring Street who have a ground floor business located on Spring Street from Union Place to Main Street. The cost for such passes is set forth in § 100-15C of the Town Code. There will be a maximum allotment of four passes per business per year. Annual passes will be valid from January 1 to December 31, semiannual passes are valid from January 1 to June 30 or July 1 to December 31, and all passes will need to be renewed upon expiration. Parking passes are valid from 8:00 a.m. to 6:00 p.m., Monday to Friday.

An annual parking pass is available for up to six parking spaces in the municipal building parking lot. The municipal building parking pass permits vehicles to be parked for a twelve-hour period, either 8:00 a.m. to 8:00 p.m. or 8:00 p.m. to 8:00 a.m. Each twelve-hour period requires a separate pass to permit parking in the municipal building parking lot. The cost for such municipal building parking lot pass is as set forth in § 100-15C of the Town Code. There is a maximum allotment of six passes for the municipal building parking lot per year. The annual pass is valid from January 1 to December 31 only, and all passes shall be renewed upon expiration. The Town Manager or his designee shall be authorized to limit the purchase of said municipal building parking lot passes based on the parking needs of municipal staff and visitors.

A. 
Definitions. For purposes of this chapter, the following phrases and words shall have the meanings indicated:
CHARGING STATION
A location fitted with electric vehicle charging station equipment.
CHARGING STATION EQUIPMENT
The conductors, including ungrounded and grounded, and the electric vehicle connectors, attachment plugs, and all other fittings, devices, power outlets, charging status, or apparatus installed specifically for the purpose of delivering electrical energy from the charging station to the electric vehicle.
CHARGING STATION SPACE
A dedicated, marked parking space fitted with charging station equipment and exclusively used for the charging of electric vehicles.
ELECTRIC SCOOTER and/or ELECTRIC MOTORCYCLE
A two-wheel or three-wheel electric vehicle that operates exclusively on electrical energy stored in the vehicle's batteries.
ELECTRIC VEHICLE
Any vehicle licensed and registered for operation on public and private highways, roads, and streets and operates, either partially or exclusively, on electrical energy from a charging station or other electrical energy source stored in the vehicle's battery for propulsion purposes. Electric vehicle includes: a battery electric vehicle; a plug-in hybrid electrical vehicle; a neighborhood electric vehicle; and electric scooters or electric motorcycles.
NEIGHBORHOOD ELECTRIC VEHICLE
An electric vehicle that is a low-speed vehicle, built to have a top speed of 25 miles per hour and have a maximum loaded weight of 3,000 pounds.
NON-ELECTRIC VEHICLE
A vehicle that does not meet the definition of "electric vehicle" as provided herein.
PLUG-IN HYBRID ELECTRIC VEHICLE or PHEV
An electric vehicle that: contains an internal combustion engine and also allows power to be delivered to drive wheels by an electric motor; charges its battery primarily by connecting to a charging station or other electrical source not on board the vehicle; may additionally be able to sustain a battery charge using an on-board internal-combustion-driven generator; and has the ability to be propelled through the use of electricity.
B. 
Public parking spaces for charging of electric vehicles. The Town may designate public parking spaces for use as electric vehicle charging stations. Use of said charging station spaces shall be limited and restricted as follows:
(1) 
Public parking spaces with charging stations for electric vehicles are available on a first-come-first-served basis.
(2) 
Pavement markings painted on the surface of a public parking space and signage identifying public parking spaces as charging stations are provided to identify such spaces.
(3) 
It shall be unlawful for any person to park or leave standing a vehicle in a stall or space designated as a charging station unless the vehicle is an electric vehicle and is connected for electric charging purposes.
(4) 
Nonelectric vehicles are prohibited from parking in charging station spaces.
(5) 
Electric vehicles are authorized to park in spaces designated as charging station spaces during the time the vehicles are connected for electric charging purposes. When the vehicle is no longer charging, the owner or operator of said vehicle shall be required to remove the vehicle from the charging station space.
(6) 
The Town will periodically check charging receptacles to ensure the devices are working and capable of safe operation.
(7) 
Electric vehicles shall not park in any electric vehicle charging space for more than one hour.
C. 
Charging station fees. The fee to use public parking spaces within the Town identified as charging station spaces shall be set forth in Chapter 100, Fees and Costs, for when the electric vehicle is connected to the charging station.
D. 
Designation of public parking spaces for electric vehicle charging. The following location(s) shall be designated as public charging station spaces:
(1) 
Two public parking spaces in municipal Lot No. 4 Central Plaza.
E. 
Violations.
(1) 
Pursuant to N.J.S.A. 40:48-2, publicly accessible electric vehicle charging station parking spaces shall be monitored by the Newton Police Department, Newton Parking Authority, and any other law enforcement agency, and other enforcement agency having jurisdiction for parking within the Town of Newton.
(2) 
Violations of this section shall result in a penalty of $100 per offense.
