As used in this chapter:
"Peddler"
means every person selling and making immediate delivery or offering for sale and immediate delivery of any goods, wares, merchandise or thing in possession of the seller at a public place within this Town or by going uninvited to the residence or place of business of any person.
"Solicitor"
means any person selling or taking orders or offering to sell or take orders for goods, wares, merchandise or things for future delivery or for services to be performed, at a public place within the Town or by going uninvited to the residence or place of business of any person.
"Solicitor of funds"
means any person personally requesting in a public place, or by going uninvited to the residence or place of business of any person, funds represented to be used for a charitable, welfare, educational or religious purpose. The term shall not be construed to include fund solicitations by mail or by telephone.

A. 
Any organization, business or person not represented by an organization or business shall pay the license tax pursuant to Chapter 5.04 and obtain a permit issued by the Town Manager prior to peddling, soliciting, or soliciting for funds.
B. 
If an organization, business or person not represented by an organization or business receives a sidewalk vending permit under Chapter 12.02 of the Yountville Municipal Code, they shall not be required to receive a permit issued under this chapter for any activities permitted under the sidewalk vending permit.
C. 
No fee or tax shall be charged for a permit sought under this chapter by a solicitor of funds.

A. 
At least 10 days prior to peddling, soliciting, or soliciting for funds, every organization, business or person requiring a permit as provided for in this chapter shall make written application, signed under oath, to the Town Manager for such a permit on forms provided by the Town. The application shall contain the information required by this chapter. Permits, if granted, will terminate at the end of the period requested by the applicant in their application. In no event shall this period exceed 12 months. Permits may be renewed by the Town Manager upon payment of applicable fees and taxes.
B. 
No fee or tax shall be charged for a permit sought under this chapter by a solicitor of funds.

Any organization, business or person requiring a permit to engage as a peddler or solicitor shall disclose on its application the following information:
A. 
The name, address and telephone number of the organization, business or person.
B. 
The name, address and telephone number of the person filling out the form.
C. 
The kind of goods offered for sale or the kind of services to be rendered.
D. 
The manner, dates and locations of peddling and soliciting.

Any organization, business or person requiring a permit to engage as a solicitor of funds shall disclose on its application the following information:
A. 
The name, address and telephone number of the organization, business or person.
B. 
The purpose for which funds are sought.
C. 
The names, addresses and telephone numbers of two persons who will answer further inquiries regarding the solicitation.
D. 
A statement as to whether the organization is incorporated in any state, the state of incorporation, whether the organization is incorporated on a profit or nonprofit basis.
E. 
A statement as to whether donations to the organization are deductible on Federal Income Tax returns and an Internal Revenue Service identifying number.
F. 
A list of all organizations or individuals not listed in the response to the requirement of subsection A which may receive any portion of the funds solicited, or which may receive any goods or services obtained as a result of the solicitation.
G. 
The name, address and telephone number of the person filling out the form.
H. 
The manner and dates of solicitation of funds.

Permits may be denied or revoked by Town Manager for any of the following reasons:
A. 
Fraud, misrepresentation, or any false statement made in furnishing the information required by this chapter.
B. 
Any violation of this chapter.
C. 
Conviction of the permit holder of any felony, crime involving moral turpitude, or any crime committed while peddling, soliciting, or soliciting for funds.

The permit issued pursuant to this chapter, or a copy of the permit must be carried by each peddler, solicitor, solicitor of funds at all times when peddling, soliciting, or soliciting for funds and such person shall display the permit upon the demand of any person to whom such person is peddling, soliciting, or soliciting for funds.

At all times when peddling, soliciting, or soliciting funds in public, each person shall wear a badge of a uniform type, subject to approval by the Town Manager stating his or her name and the name of the organization or business for which he or she is peddling, soliciting, or soliciting for funds. The name of the organization or business shall be the same as disclosed under this chapter.

No person shall peddle, solicit, solicit funds or canvass by entering any yard, house, structure or private property where there is posted a sign stating "No Solicitors or Peddlers" or language of similar import.
