The Town Council hereby finds and determines that the foregoing recitals, which are incorporated herein by reference, are each relied upon independently by the Town Council for its adoption of the ordinance codified in this chapter.

Chapter 5.60 of Title 5 of the Napa County Code of Ordinances relating to permit requirements for elder and/or dependent adult caregivers, is hereby adopted by reference as it is now constituted and as amended in the future, to the extent that it does not conflict with and/or is inconsistent with the Town of Yountville Municipal Code as it is now constituted and as amended in the future. Any fees required by the County of Napa in the processing of permit applications required by the ordinance codified in this chapter shall be as imposed by the Board of Supervisors by Board resolution and paid to the appropriate County designated office.

Violation of this chapter is a misdemeanor or infraction, punishable by a fine, imprisonment in the county jail up to one year, or a combination of both.

Pursuant to the requirements set forth in Section 50022.6 of the Government Code, upon adoption of the ordinance codified in this chapter, one copy of the County's Ordinance adopted by reference shall be maintained by the Town's Enforcement Officer.

Should a court of competent jurisdiction find any provision of this chapter or its application to any person or property to be invalid or unenforceable, the remaining provisions hereof shall be enforceable according to their terms and to that end, the provisions of this chapter are severable.

To the extent the provisions of the Town of Yountville Municipal Code as amended by this chapter are substantially the same as previous provisions of that Code, those provisions shall be construed as continuations of those previous provisions and not as new enactments.
